BACKGR0UNm:
~ The applicant, Mr. William Menko, is requestitjg annetiation of 1.05 acres of pcoperty into tne
Cardiff Sanitation Dis[rict. 7'he property currently contains a single-fai.rii1%. hou_~: that is
co..nected to a septic tank.
Th.e applicant has documented a failing septic systein (Attachment 5) a.nd is petitioning tor ar_
emergency connection to the public, sewer, prior to the completion of the annexation process, to
address the health and safety siiuation. The District is authorized ta enter into a temporar}service contract (subject to final approval from LAFCO) to provide sewer service to the prop:rtV
prior ta the completion of aniiexation. The property ~~~mer's appiication for annexatia7 muit
accompany the request :or a Temporary Service Agreement. If approved, the Cardiff Sanitation
District agrees to "contract" with the property owner to provide sewer service until the propen}is annexed to the District. ~
Pursuant to CEQA Guidzlines Sections i5319(b) and 15-3303(a) w•nicn exempt "anrtexatiuns vi ~
individual small parcels," this project is categorically e-xempt (Class 19) from environmental
review.
ANAL'YSIS:
'i'he proposed annexation is in conformance with the Cardiff Sanitat:on Qoard's poiicy for
anriexations of single-family dwellings on Izgal size lots, conforms with the current Rura!
Residentiai zoning, and is within the District's si heze of influer_ce.

The CardiffSanitation Distrtict, hereinaher called the District, anQ Wiliiam Menko herrinaftcr callyd
the Owner(s), aQree as follows:
1. T'ne G-*:rer(s) represent that they hold Titie to the described real propert} in ~'s,r City of Encinitas, Statc
of Caiifornia, As-,~ess4r's Parcel Number 264-232-23 (see at*.ached legai dcscriE tion).
2. That said real prvperty is located outside of the boundaries of the District, but w ithin the sphrre of
in'lluence for the District.
3. That the Owner(s) shali have the privilege of conrtecting the srwrr lin: frvr~ the structure iocatr~l on
said real proper.ry to the C~istrict' s sanitary sewers knuwn as Cardiff Sanitatior Distrirt.
4. That the connection to the District's sanitary sewer shall te Z-iade under the directian of the
Engineering Services Department of the City of Encinitas, in accardance with the ordinancrs a:xi
regalations of the City, dnd shall be made at such piace on the llist-ict's sanitary srwer and in such
manner as the Director of Engineering Services of the City of Enciritas shall specify_ The cost of such
connection shall be paid by the Owner(s).
5. At the time of subrnission of the annexatian application, the Ownes(s) shall pay a Praccssing fre and
LAFCO annexation fee. Prior to annexation to the District, the Owner(s) shall pay the requircd 5tat=
Board of Equalization filing fee to the District. In addition, a capacit;• fcr ?nd anr other appficab?e fees
are to be paid at the time of issuance of ttie WasteNvater Discharge Permit.
6. The Owner(s), O%ners' execueors, aaministrators, heirs, successors and assigns shail pay to the
District through the Engineering Servic.e!i Qepartment of the Cii; vf Fncinitaft prior to the connection
ofthe property defined in thii agreement, an annual scwer scrvice t::: at the p:rvailing ratc, pra-mted at
~ tinle of permit issuance, payable in advanc:e. Said fee shall be pa'sd vh on annual basis thzrrafecr, a:id
shall be collected through the properry ta: rolls.
7. The District shall have the power to increase the amount af the anntial cewer servi;:e charge prescribed
in Paragraph 6 in propoction to any increased cost of expenses of operating the District.
8. The Owner(s) of said real property consent to the commencemcnt ot pracecdings by the Distrirt to
annex said properry to the District. The 01, ner(s) agrees to actively pursue and eomplete the
annexat'sctn of this property even 3f the propem• is sold during this praccss. The Gwner(s) agree that,
upon annexation of the above described reai property to the Qistrict. said propercy shali becomc subject
to any and all regulations, fees, taxes and assessments appiicable to the praperty w•ithin the Distriet.
9. The District agrees that tipon connection of said property to the Uistrict's sanitary• sewrr, the f)istrict
