BACKIsIa4UND: On Dece:nber 13, 2000 the Cardiff Sanitation District Board approved an
application for annexation to tfie District frorn %v1r. Witliam Bartkr. }-tis applicatian %tias
~ subsequently furwsrdeu ta LAFCO for review and approval by the I.Af-(_O Boitrd. 'v1r. fianNer's
request for arslexation is due to a failing septic system.
LAFCO is tinable to schedule a hearing for the Barber's annetation request pnur tu their N-larch
meeting. Due to the health and safeiy problems created b; the failing septic systems, Lir. f3arber
requests ater:lporary service contract to aljow him to connect to the ,rublic s<«•er system a.s soon
as possible.

The Cardiff Saniiati.;n District, hereinafter called the District, and Mr. William Barbrr herrinaftcr ca6led
the Owa;,r(s), aaree as fol+ows:
1. The O-Amer(s) represent that they hoid Title tce the descr:bed real Frvprrtv in the Cit-, of E=ncii►itas, Statc
of Califomia, Assessor's Parcel Number 265-3554-5 (see attar.hed legai description).
2. That said reat property is located outside of the boundaries of the District, but within the sphrre of
irSfluence for ttie District.
3. That the nwner(s) shall have the privilege o; conneci'tng the srNvrr line froni the sYructurr locatrd an
said real property to the District' s sanitarv se-wers knuwn as CardifrtSanitacion Districr.
4. That the connectior to the District's sanitary sewer shall be made undrr the :i:rrction ef the
Engineering Services Department ai the City of Encinieas, in accordancr w•ith the ordir.ancrs and
regulations of the City, anc; sha11 be rnade at such place on tne wnitar} srwrr and in such
manner as the Director of Engineerir.g Services of the City of En_initas shall specify. The cost of such
connection shall be paid by the Owner(s).
5. At the time of submission of the annexation applicatioii, the Ownrr(s) shali nay a procrssine, fre and
LAFCC) annexation fee. Prior to annexation to the District, the 0wncrts) shall Pay the requircd Swtc
Board of Eqnalizatian filing fee ta the District. tR addition, a cap-Ac i:y fee arci any othci applicable fres
are to be paid at the time of' issuance of the Wastewa:er 1.,,::.harge Permit.

6. The Owner(s), Owr.en' executors, administrators, heirs, successors and assigr.s shall pay to the
District through the Engineering Services Department of the Ciiy of Encin►►as prior to the conncccion
af the property defined in this agreement, an anolual sewer service fee m the prrvailing ;atc, procaecd at
time cf permit issuance, payable in advance. Said fee shall bc paid s,n :sn annual basis thereafiicr, and
shal1 be coliectea through the property tax rolls.
7. The District shall have the puwer to increase the amount of the annual sewer service charge prescnbc3
in Paragraph 6 in proportion to any increased cost of expenses of opersting the District
8. The Owner(s) of said mal property consent to the commencement of procr.edings by the UistTict to
annex saicf property to the District. The 04yner(s) agrees to activefy pur=,-ue and compleu thc
annexation af this property even if t,"ie property is sotd during .his process. Ttie Owner(s) agrec that.
upon annexation of the above described real prope:ty to the District, said propenv shali become subJect
to any and aJl regulations, fees, taxes and assessments applicab{e to ttie propemr within ttae Uisaict.
9. The District agrees that upon connection of said property to the District's sanitary sewer, the District

10. This Agreemei-it n3ay be termir.ated by the Owner(s), Ow•ners' executors, administrators, heirc,
successars or assigns by giving to the Distriet ninety (90) days written notice of inteiition to terminate
by serving such notice to the Clerk of the Board of Directors af the District.
11. This Agreement may be terminateci by the District by giving ninety (90) da•~. written notics of
intention to terminate :o the Owner(s), Owners' executors, administrator-s, hein, successors or assigns.
