RELEASE OF COVENANT
AGREEMENT TO REMOVE STRUCTURES
A covenant agreement was entered into on the 25th of April, 1969 (which was recorded as
File No. 99897 on May 27,1969 with the County Recorder of the County of San Diego) by and
between the County of San Diego and the owners of the subject property at that time, Gaylord P.
Bahlman, Ruth Bahlmann, and Dirk Jacobus Dolman and Edra Dolman as I st Trust Deed
Holders to allow construction of greenhouses on the subject property with the agreement that if
the property owner would remove the greenhouse structures at any such time all or any part of
the subject property was required for public highway purposes. Whereas, the subject property
now lies within the corporate boundaries of the City of Encinitas, and the City having
determined that the greenhouse structures that were the subject of the above-referenced
agreement have been removed by the current property owner, Shea Homes Limited Partnership, a
California Limited Partnership, the City hereby releases the above-referenced agreement as being of
no further force or effect.
