e BACKGROUND:
The applicant, Mr. Alvin Mayo, is requesting annexation of 16.67 lIcres of property into the
Cardiff Sanitation District. Annexation to the Cardiff Sanitation District is a condition of
approval of TPM 99-207, approved by the Planning Commission on July 27, 2000. The
development project consists of four single-family residential parcels and a Remainder Parcel.
In conjunction with this development, the applicant will extend the sewer main to serve the
future residences. The cost of the sewer improvements will be entirely at the expense of the
developer.
The Planning Commission reviewed the Environmental Initial Study prepared for the project and
determined that, with the incorporation of mitigation measures, the environmental impacts of the
project would be insignificant and adopted a Mitigated Negative Declaration.
ANALYSIS:
The proposed annexation is in conformance with the Cardiff Sanitation Board's policy for
annexations of single-family dwellings on legal size lots, conforms with the current Rural
Residential zoning, and is within the District's sphere of influence.

e FISCAL AND STAFF IMP ACTS:
The annexation will generate $700 in processing fee revenues and $3417/EDU in capacity fee
revenues to the District.
RECOMMENDATIONS:
Staff recommends that the Board of Directors adopt Resolution No. 2000-20, Application for
AnneXCltion to the Cardiff Sanitation District of 16.67 acres located at the terminus of Wildflower
Road - Mr. Alvin Mayo Annexation (Assessor's Parcel No. 264-091-59).

RESOLUTION OF APPLICATION TO THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATiON OF TERRITORY
"ALVIN MAYO ANNEXA nON"
WHEREAS, this Board of Directors has received a request from Mr. Alvin Mayo that !~e
hereinafter described territory be annexed to the Cardiff Sanitation District (hereinafter referred
to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate proceedings to annex said territory
to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
l. Pursuant to Government Code Secli"ns 56800 and 56700, application is hereby made to
the Local Agency Formation Commission of the County of San Diego for a proposed
change of organization as follows:
A.
This proposal is made pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (S. 56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization and the names of all districts
for which any such change of organization is proposed are as follows: Tne
annexation of the hereinafter described territory to the Cardiff Sanitation District.
C. The names of all other affectcd counties, cities and districts are: City of Encinitas.
D. A description of the exterior boundaries of the territory proposed to be annexed to
the Sanitation District is described in "f.ttachment 2" hereto attached.
E. Said territory is uninhabited and comprises approximately 16.67 acres.
F. It is proposed that said territory be annexed subject to the following condition:
Payment of District processing, Local Agency Formation Commission processing,
and State Board fees.
G. All the owners of land within such territory have given their written consent to
such annexation subject to the aforementioned terms and conditions.

The reasons for this proposal are as follows:

The Sanitation District is empowered to and is engagtd in furnishing
sewage disposal facilities.
(2) The territory proposed 1.0 be annexed to said District is developed and/or
proposed to be developed and used for residential and/or-commercial
purposes and provision for sewerage disposal facilities for said territory is
essential for such pWlloses.
l. It is hereby requested that proceedings be taken for the annexation of territory as
herein above proposed.
J. This annexation is consistent with the sphere of influence of the Sanitation
District.
K. The Board C011Curs with the City of Encinitas Planning Commission's
determination that, with the approved mitigation measures, the project will have

PARTY DISCLDSURE FORM
LAFCOs are subject to the campaign disclosure provisions detailed in Governmen~
Code Section 84308, and the Regulations of the Fair Political Practices Commission
(FPPC), Section 18438. Please carefully read the following Information to

1. No LAFCO commissioner shall accept, solicit, or direct a contribution of more

LAFCO. This prohibition commences when your application has been filed, or the
proceeding is otherwise initiated.

"Party" is defined as any person who files an application for, or is the subject of, a
proceeding.
"Agent" is defined as a person who represents a party in connection with a
proceeding, If an individual acting as an agent also is acting as an employee or
member of a law, architectural, engineering, or consulting firm, or a similar entity or
corporation, both the individual and the entity or corporation are agents. When a closed
corporation is a party to a proceeding, the majority shareholder is subject to these
provisions.
2. A party to a LAFCO proceeding shall disclose on the record of the proceeding
any contribution of more then $250 made to any commissioner by the party, or agent,
during the preceding 12 months. No party to a LAFCO proceeding, or agent, shall
make a contribution to a commissioner during the proceeding and for three months
following the date a final decision is rendered by LAFCO.
3. Prior to rendering a decision on a proceeding, any commissioner who received
contribution of more than $250 within the preceding 12 months from any party, or agent,
to a proceeding shall disclose that fact on the record of toe proceeding, and shall be
disqualified from participating in the proceeding. However, if any commissioner
receives a contribution that otherwise would require disqualification, and returns the
contribution within 30 days of knowing about the contribution and the relevant
proceeding, that commissioner shall be permitted to participate in the proceeding.
