SUBJECT: Adoption of Resolution No. 2000-19, Application for Annexation to the Cardiff
Sanitation District of 0.42 Acres Located at 525 Camino EI Dorado - Tony Cassolato
Annexation (Assessor's Parcel No. 258-140-78, portion of).
BACKGROUND: Mr. Tony Cassolato is petitioning for annexation of 0.42 acres to the Cardiff
Sanitation District. The property is a portion (one lot) of a four-lot subdivision, that was
approved as TPM/CDP/EIA 00-058 by the Community Development Department on September
21, 2000. The future structure on this lot wiIl connect to the existing sewer main in Camino EI
Dorado. Annexation of the property to the Cardiff Sanitation District is a condition of approval
for TPM/CDP/EIA 00-058.

The Commwlity Development Director reviewed the Environmental Initial Study and adopter! ..
Mitigated Negative Declaration, in accordance with the provisions of the California
Environrm:ntal Quality Act (CEQA).
ANALYSIS: The proposed annexation is in conformance with the Cardiff Sanitation Board's
policy for annexations of legal size lots, confonns with the current residential zoning, and is
within the District's sphere of influence.
FISCAL AND STAFF IMPACTS: The annexation will generate $700 in processing fee
revenues and $3417/EDU in capacity fee revenues to the District.
RECOMMENDATIONS: S:affrecommends that the Board of Directors adopt Resolution No.

RESOLUTION OF APPLICATION TO THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
"TONY CASSOLATO ANNEXATION"
WHEREAS, this Board of Directors has received a request from Mr. Tony Cassolato that
the hereinafter described territory be annexed to the Cardiff Sanitation District (hereinafter
referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate proceedings to annex said territory
to the Sanitation District;
BE IT RESOLVED AND ORDERED as foIlows:
I. Pursuant to Government Code Sections 56800 and 56700, application is hereby made to
the Local Agency Fonnation Commission of the County of San Diego for a proposed
change of organization as foiIows:
A.
This proposal is made pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (S. 56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization and the names of all districts
for which any such change of organization is proposed are as foIlows: The
annexation of the hereinafter described territorj to the Cardiff Sanitation District.
C. The names of all other affected counties, cities and districts are: City ofEncinitas.
D. A description of the exterior boundaries of the territory proposed to be annexed to
the Sanitation District is described in "Attachment 2" hereto attached.
E. Said territory is uninhabited and comprises approximately 0.42 acres.
F. It is proposed that said territory be annexed subject to the following condition:
Payment of District processing, Local Agency Fonnation Commission processing,
and State Board fees.
G. All the owners of land within such territory have given their written consent to
such annexation subject to the aforementioned tenns and conditions.
H.

The Sanitation District is empowered to and is engaged in furnishing
sewage disposal facilities.
(2) The territory proposed to be annexed to said District is developed and/or
proposed to be developed and used for residential and/or commercial
purposes and provision for sewerage disposal facilities for said territory is
essential for such purposes. .
I. It is htTeby requested that proceedings be taken for the annexation ofterritory as
herein above proposed.
J. This annexation is consistent with the sphere of influence of the Sanitation
District.
K. The Board concurs with the Community Development Director's findings and
adopts a Mitigated Negative Declaration for the project.
The Clerk of the Board of Directors is hereby authorized and directed to file a certified
copy of this resolution with the Executive Officer of the Local Agency Fonnation
Commission of the County of San Diego.

LAFCOs are subject to the campaign disclosure provisions detailed in Government Code
Section 84308, and the Regulations of the Fair Political Practices Commission (FPPC),

1. No LAFCO commissioner shall accept, solicit, or direct a contribution of more than

This prohibition commences when your application has been filed, or the proceeding is
otherwise initiated.
_ "Party" is defined as any person who files an application for, or is the subject of,
a proceeding.
"Agent" is defined as a person who represents a party in connection with a
proceeding. If an individual acting as an agent also is acting as an employee or member
of a law, architectural, engineering, or consulting firm, or a similar entity or corporation.
both the individual and the entity or corporation are agents. When a closed corporation
is a party to a proceeding, the majority shareholder is subject to these provisions.
2. A party to a LAFCO proceeding shall disclose en the record of the proceeding any

contribution to a commissioner during the proceeding and for three months following the
