Adoption of Resolution No. 2000-18, Application for Annexation to the Cardiff Sanitation
District of 0.50 Acres Located at 642 Rancho Santa Fe Road - Barber Annexation (Assessor's
Parcel No. 265-355-45).
e BACKGROUND:
The applicants, Mr. and Mrs. William Barber, are requesting mnexation of 0.50 acres of proper "
into the Cardiff Sanitation District. The applicants have a failing septic system and wish l
connect to the public sewer.
The applicants plan to construct approximately 300' of sewer line to the sewer main in Rancho
Santa Fe Road. The cost of the improvements will be paid entirely by the applicants.
The project is categorically exempt (Class 19) from environmental review pursuant to CEQA
Guidelines Sections 15319(b) and 15303(a) which exempt "annexations of individual small
parcels" including, but not limited to, "up to three single family residences..."
ANALYSIS:
The proposed annexation is in conformance with the Cardiff Sanitation Board's policy for
annftxations of single family dwellings on legal size lets, conforms with the current Rural
Residential zoning, and is within the District's sphere of influence.
FISCAL AND STAFF IMP ACTS:

The annexation will generate $700 in processing fee revenues and $3417/EDU in capacity fee
revenues to the District.

Staff recommends that the Board of Directors adopt Resolution No. 2000-18, Application for
Annexation to the Cardiff Sanitation District of 0.50 Acres Located at 642 Rancho Santa Fe

RESOLUTION OF APPLICATION TO THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
"BARBER ANNEXATION"
WriEREAS, this Board of Directors has received a request from Mr. and Mrs. William
Barber that the hereinafter described territory be annexed to the Cardiff Sanitation District
(hereinafter referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate proceedings to annex said territory
to the Sanitation District;
BE IT RESOL YED AND ORDERED as follows:
1. Pursuant to Government Code Sections 56800 and 56700, application is hereby made to
the Local Agency Formation Commission of the County of San Diego for a proposed
change of organization as follows:
A. This proposal is made pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (S. 56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization and the names of all districts
for which any such change of organization is proposed are as follows: The
annexation of the hereinafter described territory to the Cardiff Sanitation District.
C. The names of all other affected counties, cities and districts are: City of Encinitas.
D. A description of the exterior boundaries of the territory proposed to be 8IU1exed to
the Sanitation District is described in "Attachment 2" hereto attached.
E. Said territory is uninhabited and comprises approximately 0.50 acres.
F. It is proposed that said ~errltory be annexed subject to the following condition:
Payment of District processing', Local Agency Formation Commission processing,
and State Board fees.
G. All the owners of land within such territory have given their written consent to
such annexation subject to the aforementioned terms and conditions.
H. The reasons for this proposal are as follows:

The Sanitation District is empowered to and is engaged in furnishing
sewage disposal facilities.
(2) The territory proposed to be annexed to said District is developed and/or
proposed to be developed and used for residential and/or commercial
purposes and provision for sewerage disposal facilities for said territory is
essential for such purposes. '
1. It is hereby requested that proceedings be taken for the annexation of territory as
herein &bove proposed.
J. This annexation is consistent with the sphere of influence of the Sanitation
District.
K. The Board finds that the annexation is categorically exempt from environmental
review in accordance with CEQA Class 19, Section 15319(b) and Section
l5303(a).
The Clerk of the Board of Directors is hereby authorized and directed to file a certified
copy of this resolution with the Executive Officer ofthe Local Agency Formation
Commission of the County of San Diego.

1. No LAFCO commissioner shall accept, solicit, or direct a contribution of more than $250 from
any party, or agep.~, while a change of organization proceeding is pending, and for three months
subsequent 10 tJ:le date a final decision is rendered by LAFCO. Tnis prohibition commences
""hen your application has been filed, or the proceeding is otherwise initiated.
"Party" is defined as any person who files an application for, or is the subject of, a proceeding.
"Agent" :3 defined as a person who repre~ents a party in connection with a proceeding. If an
individual acting as an agent also is acting as an employee or member of a law, architectura1,
engineering, or consulting firm, or a similar entity or corporation, both the individual and the
entity or corporation are agents. When a closed corporation is a party to a proceeding, the
m.yority shareholder is subject to these provisions.
2, A party to a LAFCO proceeding shall disclose on the record of the proceeding any contribution of
more than $250 made to any commissioner by the party, or agent, during the preceding 12
months. No party to a LAFCO proceeding, or agent, sball make a contribution to a
commissioner during the proceeding and for three months following the date a final decision is
rendered by LAFCO.
3. Prior to rendering a decision on a proceeding, any commissioner who received contribution of
more than $250 within the preceding 12 months from any party, or agent, to a proceeding shall
disclose that fact on the record oft4e proceedine-, and shall be disqualified from participating in
the proceeding, However, if any commissioner receives a contribution that otherwise would
require disqualification, and returns the contribution within 30 days of knowing about the
contribution and the relevant proceeding, that commissioner shall be pennitted to participate in
the proceeding.
To delennine whether a campaign contribution of more than $250 has been made by you or your
agent to a commissioner within the preceding 12 month~. al! contributions made by you or your
agent during that period must be aggregated.
