BACKGROUND:
The applicant, Mr. Wayne Pasco, is requesting annexation of 2.3 acres of property into the
Cardiff Sanitation District on behalf of property owners Pauline Jordan and Gerald Tate. The
applicants have failing septic systems and wish to connect to the public sewer.
The applicants plan to construct approximately 300' of 8" sewer main at an estimated cost of
$20,000. The cost of the improvements will be paid entirely by the applicants.
The project is categorically exempt (Class 19) from environmental review pursuant to CEQA
Guidelines Sections 15319(b) and 15303(a) which exempts "anr.exatio:-.s of individual small
parcels" including, but not limited to, "up to three single family residences...
ANALYSIS:
The proposed annexation is in conformance with the Cardiff Sanitation Board's policy for
annexations of single family dwellings on legal size lots, confonns with the current Rural
Residential zoning, and is within the District's sphere of influence.
FISCAL AND STAFF IMPACTS:
The annexation will generate $700 in processing fee revenues and $3417/EDU in capacity fee

RECOMMENDATIONS:
Staff recommends that the Board of Directors adopt Resolution No. 2000-17, Application for
Annexation to the Cardiff Sanitation District of 2.3 Acres Located at 1375 & 1385 Trabert

RESOLUTION OF APPLICATION TO TBE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
"JORDANfI' A TE ANNEXATION"
WHEREAS, this Board of Directors has received a request from Mr. Wayne Pasco that
the hereinafter described territory be annexed to the Cardift Sanitation District (hereinafter
referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate proceedings to annex said territory
to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
I. Pursuant to Government Code Sections 56800 and 56700, application is hereby made to
the Local Agency Formation Commission of the County of San Diego for a proposed
change of organization as follows:
A.
This proposal is made pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (S. 56000, et. seq., Govt. Code).
B.
The nature of the proposed change of organization and the names of all districts
for which any such change of orga'lization is proposed are as follows: The
annexation of the hereinafter described territory to the Cardiff Sanitation District.
C. The names of all other affected counties, cities and districts are: City of Encinitas.
D. A description of the exterior boundaries of the territory proposed to be annexed to
the Sanitation District is described in "Attachment 2" hereto attached.
E. Said territory is uninhabited and comprises approximately 2.3 acres.
F. It is proposed that said territory be annexed subject to the following condition:
Payment of District processing, Local Agency Formation Commission processing,
and State Board fees.
G. All the owners of land within such territory have given their written consent to
such annexation subject to the aforementioned terms and conditions.
H. The reasons for this proposal are as follows:

sewage disposal facilities.
(2) The territory proposed to be annexed to said District is developed and/or
proposed to be developed and used for residential and/or commercial
purposes and provision for sewerage disposal facilities for said territory is
essential for such purposes.

C. "Zones" include temporary zones in highway lighting districts, other zones, zone of
impi'Ovement, zone of benefit, improvement districts, or any other sub-units of a county,
e city, or parent district.
D. "Concurrent transaction" includes any combination of fonnations, annexations, and
withdrawals of a single area under one resolution or ordinance. The fee shall be
according to the fee schedule; there is no additional costs for the number of transactions
involved. If there is more than one resol~tion or ordinance, each single area must be
separately computed under the above fee schedule.
E. The fees in this schedule are based on the concept that any given action is confined to a
single county. If more than one county is involved, add $300 for the second and each
additional coUnty involved.
F. Coterminous transaction: If an annexed or detached territory comprises an entire city,
district, or zone without affecting the existence of that city, district, or zone, the total
processing fee shall be $300. If the coterminous transaction contains areas of exclusion,
each area of exclusion shall be considered a single area transaction, and all requirements
shall apply and the fees calculated as such. Example: A district is formed coterminous
with a city boundary and contains two areas of exclusion of four acres ftach; the total fee
is $1,000.

G. Payment of the fee for the formation of a city or district may be deferred until that city or
district receives its first revenue. Each deferment shall be sl~"ject to a $35 billing charge.

annexation is approved by L.A.F.C.O. i~itv of Encinitas and L.A.F.C.O. fees are r1ue with

If the annexation application includes a request for an emergency connection due to health and
safety reasons, a letter from a duly licensed plumbing, sanitation, or engineering contractor, that
indicates the existing system is failing, must be submitted. A.. additional "Contractual Service
Agreement Application" and a $150 processing fee made r.dyable to the City of Encinitas must
also be submitted. Please note that L.A.F.e.O. may also req lire a processing charge of30% of the
L.A.F.C.O. annexation fees.

Note: Annexation to the sewer district is required before a Wastewater Discharge pennit that allows
connection to the sewer can be issued. Depending on the compleXity of the annexation, the process
generally takes four to seven months. A typical single family residential lot is usually annexed
within four months, while a more complex reside::ttial subdivision or commercial development
may take up to seven months.

PARTY DISCLOSURE FORM
LAFCOs are subject to the campaign disclosure provisions detailed in Government Code Section
84308, and the Regulations of the Fair Political Practices Commission (FPPC), Section 18438.
Please carefully read the following information to determine whether the provisions apply to
you. If YO\ll determine that the provisions are applicable, the attached form must he completed
aad returned with your proposal application.
I. No LAFCO commissioner shall accept, solicit, or direct a contribution of more than $250 from
any party, or agent, while a change of organization proceeding is pending, and for three months
subsequent Ii) the date a final decision is rendered by LAFCO. This prohibition commencee
when your application has been filed, or the proceeding is otherwise initiat<.d.
"Party" is defined as any person who files an application for, or is the subject of, a proceeding.
"Agent" is defined as a person who repr':sents a party in connection with a proceeding. If an
individual acting as an agent also is acting a~ an employee or member of a law, architectural,
engineering, or consulting finn, or a similar entity or corporation, both the individual r.nd the
entity or corporation are agents. When a closed corporation is a party to a proceeding, the
majority shareholder is subject to these provisions.
2. A party to a LAFCO proceeding shall disclose on the record of the proceeding any contribution of
more than $250 made to any commissioner by the party, or agent, during the preceding 12
months. No party to a LAFCO proceeding, or agent, shall make a contribution to a
commissioner during the proceeding and for three months following the date a final decision is
rendered by LAFCO.
3. Prii)r to rendering a decision on a proceeding, any commissioner who received contribution of
more th:m $250 within the preceding 12 months from any party, or agent, to a proceeding shall
disclose that fact on the record of the proceeding, ;;.~d shall be disqualifi<:d from participating in
the proceeding. However, if any commissioner receives h contribution that otherwise would
require disqualification, and returns the contribution within 30 days of knowing about the
contribution and tile relevant proceeding, that commissioner shell be permitted to participate in
the proceeding.
To determine whether a campaign contribution of more than $250 has been made by you or your
ugent to a commissioner within the preceding 12 months, all contributions made by you or your
agent during that period must be aggregated.
