UACKGI{OllNI>: Mr. Moyenuddin Sirajee is petitioning on behalf of Mr. And Mrs. Shin for
annexation of 2,53 acres to the Cardiff Sanitation District. Thc property is a portion of the future
IO-lot single-thmily reSidential dcvelopmentthat was approved as TPM/DRlCDP/EJA 98-261 by
the Planning ('ommission on March 23, 2000. Anncxation to the Cardiff Sanitation District is a
condition of approv:il. The new residences will connect to the cxisting sewer mains in Camino
,k (lrchidia and ('amino EI Dorado,
On April 26, 2000. thc Cardiff Sanitation District Board reviewed the proponent's requcst and
adopted ('SD Resolution No. :WOO-Il. approving an annexation application to the District. The
proposal was sunsequently revicwed and approved by the Local Agency Formation Commission
on August 10, 20m),
A:'IIAL YSiS: The prop"sed annexation is in contlJrlnance with the Cardiff Sanitation District
1I0ard's pol icy fill annexations of single-I~unily rcsidences on legal-sizc lots, conforms with the
curn:nt zouing. and is within the District's sphere of inlluence.
FISCAL ANI> STAFF IMPACTS: Thc annexation will gcnerate $700 in processing fee
r,'n:nues and $3417/EDl.1 in capacity tec revenues to the District.

A RESOLUTION OF THE UOAlm OF DI1~ECTORS
OF THE CARDIFF SANITATION DISTRICT
Ai"NEXING TERRITORY TO WHICH OWNERS HA \'E CONSENTED
"SOON SHIN ANNEXATION"
WI-IEREA~. pursuant to the Cortese-Knox Local Government Reorganization Act of
1985 (Govl Code, 3ection 5600 et seq.) preliminary proceedings wcrc commenced by resolution
of appl ication by this Board on Apri I 26, 2000, as Resolution No. 2000-11, for annexation to the
Cardiff Sanitation District (therealier refelTed to as the District) of certain territory therein
described. which description has becn modificd pursuant to the directions of the Local Agency
Formation Commission; and
WIIEREAS, the annexation proposed by said resolution of application was presented to
and approved by the Local Agency Formation Commission of San Diego County on August 10,
2000 and this District was designated as the conducting District and authorized by resolution of
order said anm:xation without notice or hl'aring and without an election pursuant to Government
Code. Section 56837;
NOW, THEREFORE. IT IS RESOLVED. ORDERED AND DETERMINED, pursuant to
(ioVt:rnmcnt Code Section 57025 et seq.;
a. The manner in which and by whom preliminary proceedings were commenced
was by resolution of application by this Board as stated above.
b. The territory to bc unnexed has been designated DA 00-15 by the Local Agency
Formation Commission. and the exterior boundaries of such territory are as
hereinafter described.
c. The tcrritory prop05ed to be annexed is uninharited and will be benefited by such
annexation as described in Hcalth and Safety Code Section 4830.
d. The reasons for the proposed annexation as set forth in thc resolution of
application referred to above are:
I.
The District is empowered to and is engaged in fumishing sewage
disposal facilities.
The territory proposed to be annexed to said District is developed and/or
proposed to be developed and used for residential and/or commercial
purposcs and provision for sl'wuge disposal facili!;es for said territory is
essential for such purposes.

All the owners ofland within such territory have givcn their writtcn consent to
such annexation, as provided in Government Code, Scction 56837; and thereforc,
as approvcd and authorized by the Local Agency Fonnation Commission, this
Board may adopt its resolution ordcring thc annexation without noticc and
hearing and without an election, as provided in Government Code, Scction
57002.
g. The regular County assessment role will bc utilized and the affccted territory will
not bc taxcd for existing bonded indebtcdness.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government Code
Section 57002, thc follo'.ving described incorporatcd territory in the City of Encinitas, State of
Califomia, be and it hereby is anncxed to and madc a part of the CardifTSanitation District.
IT IS FURTHER ORDERED that the Clcrk of this Board immediately transmit a certified
copy of this rcsolution along with a remittance to cover the fees required by the Government
Code Section 54902.5 to the Executivc Officer of the Local Agency Formation Commission of
San Dic60 County, so that the Executive Officcr may make the filings requircd by Chapter 8
(commcncing with Section 57200), Part 5, Division I, Title 6 of the Government Code and by
Chaptcr 8 (commcncing with Section 54900), Part I, Division 2, Title 5 of the Government
Code.
