BACK.GIH)l1ND: Mr. Tony Cassolato is petitioning on behalf of Ms. Nina Aschbrenncr for
annexation of (UX acn:s to the Cardiff Sanitation District. The applicant plans to construct 4
singlc-l~lIl1ily residences on 4 Icgal lots on Camino de Orchidia. The new residences will connect
to thc cxisting sewer main in Camino de Orchidia. Thrce of the lots are already in the Cardiff
Sanitation District. Anncxation of the fourth lot to the District is a condition of approval for
Tentativc Parcel Map ()9-244 (approved March 20, 2000).
On April 26. 2000. the ClrdilT Sanitation District Board rcviewed the proponcnt's request and
adoptcd CSD Resolution No. 2000-10. approving an anncxation application to the District. The
proposal was subsequently rcviewed and approved by the Local Agcncy Fonnation Commission
lln August 10. 2000.
ANAL YSIS: Thc proposed annexation is in conformancc with the Cardiff Sanitation District
Board's policy for anncxations of singlc-family rcsidcnces on legal-size lots. conforms with the
currcnt zoning. ami is within thc District's spherc of influcnce.
FISCAL AND STAFF IMPACTS: Thc anncxation will generate :noo in processing fee
rc\'Cnues and $3417/EDU in capacity fec revenues to the District.
IU:COMi\1ENDA TlONS: Staff recommends that the Board of Directors adopt Resolution No.
2000-15. approving annexation to thc Cardiff Sanitation District of 0.38 Acres Located at 546

A RESOLUTION OF TilE HOARD OF I>IRECTORS
OF THE CARI>IFF SANITATION I>ISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
"NINA ASCHBRENNER ANNEXATION"
WHEREAS. pursuant to the Cortese-Knox Local Government Reorganization Act of
1985 (Govt. Code, Section 5600 et seq.) preliminary proceedings wcre commenced by resolution
of upplication by this Board on April 26, 2000, as Resolution No. 2000-10. for annexation to the
Curdiff Sunitation District (thcreafter referred to as the District) of ccrtain territory therein
described, which description h~s been modified pursuant to the directions of the Local Agency
Formutinn Commission; and
WHEREAS, the annexation proposed by said resolution of application was presented to
and upproved by the Local Agency Formation Commission of San Diego Ctmnty on August 10,
:wno and this District \Vus designated as the conducting District and authorized by resolution of
order said annexation without notice or heuring and without an election pursuant to Government
Code. Section 56837:
NOW. THEREFORE. IT IS RI.:SOl.VED. ORDERED AND DETERMINED, pursuant to
Government Code Section 57025 et seq.:

Formation Commission. and the exterior bou,'..laries of such territory are as

c, The territory proposed to be annexed is uninhabited and will be benefited by such
annexation as described in Health and Safety Code Section 4830.
d, The reasons fix the proposed anncxation as set forth in the resolution of
application referred to at'lJve are:

The District is empowered to and is engagcd in furnishing sewage
disposal facilities.
The territory proposed to hc annexed to said District is developed and/or
proposed to be developed und used for residential and/or commercial
purr(,~;es and provision for sewage disposal facilities for said territory is
essentiul for such purposes,

All the owners of land within such te:ritory have givcn their written consent to
such annexation, as provided in Govcrnment Code, Section 56837; and therefore.

hearing and without an election, as provided in Government Code, Section
57002.
g. !'he regular County usseSSl11ent role will be utilized and the affected territory will
not be taxed for existing bonded indebtedness.
IT IS FlJRTllER RESOLVED AND ORDERED that pursuant to Governmcnt Code
Se(~tion 57002, the following described incorporated territory in the City of Encinitas, State of
CaliliJrllia. be and it herehy is annexed to and made a part of the CardilTSanitation District.
IT IS FlIRTllER ORDERED that the Clerk oftl is Roard immediately transmit a certified
copy ot'this resolution along with a remittance to covcr the fces required by the Government
Code Section 54902.5 to the Exccutive Officcr of the Local Agency Formation Commission of
San Diego County, so that the Executiv~ Officer may make the filings required by Chapter 8
(collllllencing with Section 57200), Part 5. Division I, Title 6 of the Government Code and by
