IN COMPLIANCE:
The Director of Community Development of the City of Encinitas has determined that the parcels of real
property described below have been divided or have resulted from a division in compliance with the
Subdivision Map Act and with provisions of the City of Encinitas Municipal Code enacted pursuant to the Act.
The parcels described herein may be sold, leased, or financed without further compliance with the Subdivision
Map Act or any 'local ordinance enacted pursuant to the Act. Development of the parcel may require issuance
of a permit or permits, or other grant or grants of approval.
It has been determined that the subject property is consistent with approved TM 98-094, which is a Planned
Residential Development. The approved PRD allowed for density transfers and modified the required lot area or
the underlying RR-1 zone. The minimum lot size in the RR-1 zone is 1 acre. However, with the approvedPRD,
TM 98-094 established lots smaller than 1 acre. The subject Lot 2 was approved under TM 98-094 with a net lot
area of.40 acre and Lot 1 was approved with a net lot area of 1.427 acres. The boundary adjustment will result in a
total net lot area of .407 acre for Lot 2 and a total net lot area of 1.420 acres for Lot 1.
