Isaiah Michael Ruczewski and Lyndee Sea Ruczewski are the owners of the Southwesterly 80 feet
of Lot 1 in Block 4 of South Coast Park, according to map thereof No. 1776 filed in the office of
the San Diego County Recorder, January 11, 1924; hereinafter called GRANTOR(S), do(es) hereby
grant, convey and dedicate an easement to the CITY OF ENCINIT AS, ST ATE OF CALIFORNIA,
hereinafter called GRANTEE, the right of way and incidents thereto for a public highway upon,
over and across that certain real property in the City of Encinitas, County of San Diego, State of
California, described as follows:
SEE EXHIBITS "A" and "B" ATTACHED HERETO AND MADE A PART
HEREOF BY THIS REFERENCE,
The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all
damages to Grantor's remaining property contiguous to the right-of-way hereby conveyed by reason
of the location, construction, landscaping or maintenance of said highway.

No. 1776 in the City of Encinitas, County of San Diego, State of California, filed in the
Office if the County Recorder of San Diego County, January 11, 1924, being more
particularly described as follows:
BEGINNING at Southwest comer of said Lot 1, said point being on the Northerly Right-
of- Way of Leucadia Boulevard being 41 feet Northerly measured at right angles to the
Centerline of Leucadia Boulevard as shown on RS. 1799-2, filed in the Office of the
County Engineer of San Diego County November 11, 1971, said point also being on the
Easterly Right-of-Way of Hermes Avenue being 25 feet Easterly measured at right angles
to the centerline of Hermes Avenue as shown on said Map 1776; thence along said
Northerly Right-of-Way of Leucadia Boulevard North 74015'22" East, 5.00 feet; thence
leaving said Right-of-Way North 42018'41" West, 11.18 feet to a point on said Easterly
Right-of-Way of Hermes Avenue; thence along said Right-of-Way South 15044'49" East,
