hereinafter called GRANTORS, do hereby grant, convey and dedicate to the CITY OF ENCINITAS, State of California,
hereinafter called GRANTEE, the right-of-way and incidents thereto for a public highway upon, over and across that certain
real properly in the City of Encinitas, County of San Diego, State of California, described as follows:

All that portion of Block 13 in COLONY OF OUVENHAIN In the City of Enclnitas, County of San Diego,
State of California, according to Map thereof No, 326, filed tn the Office of the County Recorder of San
Diego County, July 8, 1885, together with that portion of the Westerly half of 'E" Street, as vacated and
closed to public use, by resolution recorded March 4, 1915 in Book 36, Page 123 of the Supervisors
Records adjoining said Block 13 on the East, included in that land described in deed to Charles E,
Badger, et ux, Trustees, recorded September 19, 1989 as Document No. 89-504230 in said County
Recorder's Office, lying Southwesterly of the following described line:
BEGINNING at a point in the Southeasterly line of the Northwesterly 173.90 feet of said Block 13 (said
173.90 feet being measured along the Northeasterly line of Block 13), said point bears North 16°09'18'
East, 34.56 feat from the intersection of said Southeasterly line with the Northeasterly sideline of Rancho
Santa Fe Road (60 feet wide) es shown on Road Survey No, 572 (RS 572) on file in the Office of the
County Engineer of said County, said point being hereinafter designated 'Point A'; thence parallel with
the cenferline of said RS 572 and its' Southeasterly prolongation, South 27°50'10- East (record South
28°28° East per said RS 572) 267.04 feat to an intersection with said Northeasterly sideline of RS 572 and
the POINT OF TERMINUS,

The. G~antore hereby further grant to Grantee all trees, Breaths (growing o~ that may hereafter grew), and road building
materials within said easements and rlg~f-way, including the right to take water, together with the right to use the same
in such manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction,
reoonstruction, improvement or maintenance of said highway.
The Grantors, for themselves, their successors and assigns, hereby waives any claim for any and all damages to Grantors'
remaining property contiguous to the easements and rig~-of-way hereby conveyed by reason of the location, construction,
landscaping or maintenance of said highway.
