Municipal Code, Jarnes C. 5tatser and Jeanette M. Statser, as Truste3s U/A dated October 16,
1986 F.B.O. James C. St.atser and Jeanette M. Statser, as Owner, subdivider, did on the 14tt!
day of August, 1992, enter into an agreement with the City of Encinitas fo construct and install
certain public improvemer.ts in that certain subdivisiQn kncwn as TentaYive. Parcel Map No.
18928, record Parcel Map No. 17203, said improvements consisting of street and drainage
improvemerts in the City of Encinitas. Sa:d street and drainage improveme►tts were to be
Gonstructed in the public right-of-way named Coie Ranch Read.
2. Said agreement, including the plans and specifications for said ii, ~vements (Plan No.
8174-R) is on file in the Ofr"zce of the Clerk of the City of Encinitas.
3. Said improvements were completed and accepted by the Encinitas City Council on the -a th
day of April , 199~.
4. The subdivider posteci a cash deposit gtiaranteeing construction of said improvements.
5. Cash deposit: $27,145.00. 75% ($20,358.75) is hereby released and the remairaing 25%
($6,786.25) shall be released at the end of the ane-year warranty period.
6. Neither acceptance of said improvements by the Board of Directors nor this NotiGe
constitutes a waiver ^f any defects in the work of the construction or installation of said
iznprovements.
