1. Pursuant to the Subdivision Map Act of cbe State of California, and Tide 24 of the Encinitas
Municipal Code, Christopher S. Lloyd, as Trustee of the Gregory Trust under the Will of
Mazgarita Z. Lloyd dated SeptemY,er 11, 1980, Christopher S. Lloyd, a married man; and
Gregory Cleary, a married man, subdividers, did on the 10th day of November, 1994, enter into
an agreement with tY:e Cardiff Sanitation District to construct and install certair, improvements
in that certair subdivisian known as ''entative Farcel Map No. 93-053, Record Parcel Map No.
17446, said improvemants r,onsisting of public 3ewer improvements in t~`:e Cardiff Sanitation
District north of the junction of Aouble LL Ranch Road and Calle Mazgarita.
2. Said agreement, including the plans and specifications for said improvements, is on file in
the Ofrice af tiie Cleric ot die Boacu ul' Duectors. (P1an Nlc. CS-? 69;.
3. S3id improvemPnts were completed and accepted by the axdiff Sanitation riistrict on tt;e

4. 'ihe subdividers did post a cash deposit to guarantee const,-uction of said improvements.
5. Security deposit: $24,463.00. 75% ($18,347.25) is hPreby releascd and the remaining 25%
($611.5.75) shall be released at +.he end of Yhe one-year warranty geriod.
6. Neither acceptance af said impr-,vements by the Board of Directors nor this Notice
constit::tes a ivaiver of any defects >n the work of tt►e cons.ruction or installatian of said
improvements.
