1. Pursuant to the 3ubdivision Map Act cf the State of California,
and Title 24 of the Encinitas Municipal Code, Richard B. W,iro, A
Single Man, a Consert✓ateA, pursuant to Proceedings had in the San
Dieqo Countv, Superior Court, Case No. PN-2802, wherein Letters vf
('onservatorship were Issued on June 23, 1992, naming Ronald Hadlev,
as Conservator of the EstatP of said Conservatee, as Owner,
subdivider, did on the 3rc1 day of Decemher, 1992, enter into an
agrPement with th? City of Fncinitas to construct and install
certain improvements in that certain subdivision known as Tentative
Map No. 90-163, Record Map No. 12991, said improvements cansisting
of street improvements in the City of Encinitas.
2. Said agreement, including the plans and specifications for said.
improvements (Plan No. 2957 I), is on file in the Office of the
Clprk of the City of Enainitas.
3. Said improvement.s wc=r.e completed by Oliver:hain Colony Ltd. II,
a C.3lifornia limited Partnership, as the new owner, and accepted by
the Encinitas City Council on ttie (T~_ day of

4. The name of the financial institution on -che subdivider's
letter of credit guaranteeing construction of said improvements is
Ban;c of Southern California.
5. Letter of Credit: $29,825.00. 33% ($24.854.00) is hereby
released and the remaining 17% (54,971.00) shall be released at the
end of the one-year warranty periodo
5. Neither acceptance of said i:nprovemen*_s by the Boa.r.d of
Directors nor this Notice constitutes u waiver of any defects in
the work of the r.onst-.r.i_ic:fiion or installation of said improvemeni:s.
