NOTICE OF COMPLETION
1. Pursuant to the Contract for the Grandview Beach Access
Project, awarded to J. C. Baldwin Construction Company, did on July
23, 1992 enter into an agreement with the City of Encinitas to
construct certain improvements indicated in contract documents,
said improvements consisting of removal of minor existing
improvements; construction of a retaining wall; importation of fill
dirt and grading; construction of on grade concrete walkway,
fencing, miscellaneous handrails and drainage facilities;
construction of wood stairway structures from upper bluff to beach
level; erosion control and planting.
2. Said agreement, including plans and specifications for said
improvements, is on file in the Office of the City Clerk of the
City of Encinitas.
3. The name of the surety on the Contractors bonds guaranteeing
construction of said improvements and the payment of labor and
material therefore is Merchants Bonding Company (Mutual), with
policies issued on July 23, 1992.
4. Said improvements were completed and accepted by the City
Council of the City of Encinitas on the 13th day of January 1993.
5. Performance Bond # CA131438, in the amount of $428,200 is
hereby released on January 15, 1993.
6. Labor and Material Payment Bord #CA131438 in the amount of
fi428,200 is hereby released on January 15, 1993.
7. A new guarantee/warranty bond in thy: amount of $45,273.00 (10%
of the total contract amount) will be provided to the City of
Encinitas prior to the release of the two above mentioned contract
bonds. This bond will remain in effect for one year after the
Notice of Completion file date and until released by the City of
Encinitas.

8. Neither acceptance of said improvements by the city Council of
the City of Encinitas nor this notice constitutes a waiver of any
defects in the work of the construction or installation of said
improvements.
I, E. Jane Pool, City Clerk of the City of Encinitas, a Political
subdivision of the County of San Diego, State of California, which
is the owner of the public work described in the within Notice of
Completion executed by said City o Encinitas, do hereby certify
that I have read the same and know the contents thereof and that
the facts therein stated are true and of my own knowledge. I make
this verification for and on suehalf of said City of Encinitas.
