1. Pursuant ta the Subdivision Map Act or the State of Califarnia
and Title 24 0f the Enciaitas Municipal Code, So-Cal Development
Tnc., a subdivider, did on the 10th day of August 1983, enter into
an agreement with the County of San Diego to construct and install
certain improvement in that certain subdivision Y,nown as Tentative
Map No. 3808°1, Map No. 1069E, said imurove~p-nts consisting of
street and drainage improvements in the City o± _ncinitas,
2. Said agreemant, including the plans ancl specifi.cations for said
improvements, is on file in the Office of the Clerk of the City of
Encinitas.
3. Said improvements werP completed and accepted by the Encinitas
City Council on the 25th day of March, 1992.
4. Security: Since the public streets and drainage improvements on
Garden View Road, Garden View Cauart, and E1 Camino Real were
constxucted several years ago in accordance with plans appraved by
the County Engineer and the C:ity Enqineer, all seaurities aan be
re..leased a.n fu].1.
5. Neither acceptance of said improvemQnts by the City Council nar
. this No;:iae conszitutes a waiver of any defects in the work of the
constxuct-ion or in5tallation of said improvements.
