1. Pursuant to the Contract for Mildred Macphersan Neighborhood
Park Project, awarded to Plaza Landscape, Incnrpurated, did an
March 3, 1992 anter into an agreement w;+'h ttie City of Encinitas ta
construct certain improvements i.ndicated in ccontract documents,
said improvements consisting of Qverall construction of a park site
involving site preparation, stree;: improvements, concrete walkways, _
picnic units, play equipment, half-court basketball court, wrought
iron fencing, water fountain, park benches, ABQ's, landscaping ancl
irrigation.
2. Said agreement, including plans and specificatians for said
improva:nents, is on file in the Office of the City _Glerk o£ the
City of Encina.ta s.
3. The name of the surety on the Contractor's bonds guaraziteeing
construction of said i.mprovements and the payment of labor and
material trerefors is Ir.surance company of the West, with policies
issued on February 20, 1992.
4. Said improveYnents were completed and accepted by the Ci'cy
Cauncil of the City of Enainitas on the 9tli day of Septembex- 1992.
5. Performance Band in the amount of $251,041 is hereby released
on October 15, 1992.
6. I,abor and Material Yaymant Bond a.n the amount of $251,041 is
herer,y releasecl an October 15, 1992.
7. 13either acceptznce of said impravements by the CitX Gouncil of
thP City of Enrinitas r►or this riotice constitates a waiver of any
def€cts in the work of the construation or installation of said
impY•ovements.
