1. Pursuant to the Subdivision riap Act of the State of California
and Title 24 of the Encinitas Municipal Code, Robert A. Bouker,
Qlivenhain Colonv. Ltd., a subdivider, did on the 28th day of
February, 1941, enter into an agreement with the City of Encinitas
to canstruct r.ertain improvements in that certain subdivision known
as The Co'_onv, Tentative Map No. 89-173, Record Map vo. 12833, saici
improvements consisting of const-ructioii of a publia park.
2. Said agreemerit, incluc.ing the plans and specifications foz
said improvements is on file in the Office of thP City Clerk of the -
City of Encinitas.
3. Said improvements wexe compleced and accepted by the Encinitas "
City Council on the 22nd day of April, 1992.
4. SECURITY: security for warranty of the wark is in the farm of

a letter of credit ta tha City of Encinitas. Thc account is wa.th
Bank, of Sauthexn California, 1620 Fifth Ave., San Diego, CA 92101.
The amount of said letter of c.redit is as folJ.aws:
Security :or Park Improvementsa $45,000.00 - ;
5ecurity fAr TraiZ zmprovements: $3,248.00
Letter of Credit: BSC-234 Amount: $48,248.00
The security for Park Improvements shall be reduced ta $7500, and
sha11 remain in effect during the one year warranty period
commencing on the date this Notice of Completion is recorded in
the Office of the County Recorder.
The fu1l security for Trai1 Improvements shall remain on file until
aaceptaiice of such improvements.

nor this Notice, constitutes a waiver of any defects in t2xe erork of
