1. Pursuant to cne Contract f':,r aakcrest Park Playgraund -
Improvement Qroject; awarded to Marina Contractnrs, Incorporated,
did on October 22, 1991 enter into an agreement with the City of '
En.cinitas to construct aerta i-ii a.:nprovements i.ndicated in contract
dncuments, said impravements consisting of removal and replacement
of old and damaged play equipment, grading, provision af better
site visibility from interior park raads, vnlleyball court,
horseshoe courts, basketbalt r.ourt and an area for a live-on
c.ar. etaker .
2. Said agreement, including plans and specificatians for said
improve:ients, is on file in the Office of the City Clexk of the
City of Encinitas.
3. The name af the surety on the Contractor's bonds guaranteeing
construction of said improvements and the payment of labox and
material therefore is Fireman's Insurance Company of Newark, New
Jersey, 180 Maiden Lane, New York, New York 10038, with policies
issued or. October 14, 1991.
4. Said improvements were completed and accepted by the City
Gouncil of the City of Enoinitas ori the 20th day pP May 1992.
5. PPrformance Bond, Number 1331737, in the amount of $140,800
is hereby released on July 1, 1392.
6. Labor and Material Payment Bond, Number 1331737, in tlie amount
af $140,800 is hereby released on Juiy 1, 1992.
7. Neither acceptance of said improvements by the City Coiinciz of
the Ca.ty af Encinitas nor this natice constitutes a wai.ver of any
defects in the work of the canstruotion or instal7.ation of said
impravements.
