1. Pursuant to the Subdivision Map Act of the State of California and
Title 24 of the Encinitas Municipal Code, Barratt America Incorporated,
a Subdivider, did on the 10th day of January, 1990, enter into a
Covenant with the City of Encinitas to Improve Major Subdivision as a
Condition of Approval of Substitution of Parties, TM 3967, Recorded Map
No. 11532, said improvements consisting of street improvements in the
City of Encinitas.
2. Said agreement, including the plans and specifications for said
improvements, is on file in the Office of the City Clerk.
3. On January 22, 1992, that portion of improvements on Camino del
Rancho west of Calle Santa Catalina were accepted by City Council.
4. Security:
Security for Warranty of Work is in the form of a bond and is
provided by:

Bond No. 11127029053 Bond amount $118,391.00
The bond has been on file with the City for a period of one year
after the acceptance of all the improvements of TM 3967 except for those
improvements as outlined in item number 3. Therefore, this bond shall
be released in its entirety.
5. Neither acceptance of said improvements by the City Counci, nor
this Notice constitutes a waiver or any defects in the work of the
construction or installation of said improvements.
