to wells Landscape, did on the seventeenth day of January 1989
enter inta any agreement with the City of Encinitas to ~
construct and install certain improvements indicated in ~
cantract documentis, said impravements consisting of
, refurbishing the irrigation system, impravi.ng the drainage ~
system, and installir,g a handicag drinking fountain. '
2. Said agreement, including plans and specifications for said
improvements, is Gn file in the Office of the City Glerk of j
the City of Encinitas. ~
1 3. The name of the surety on the Contractor's bonds guaranteeing
construction of said improvements and the payment of labnr and
material therefore is American Motora.sts Insuranca Company,
with policies issu2d on January 18, 1989.
4. Said improvements were completed and accepted by the City
Council of the City of Encinitas on the 22nd day of March,
1989.
5. Performance Bond, Number 3 SM 716 602 00, in the amount of ~
$43,602.00 is hereby released.
6. Labor and Material Payment: Bond, Number 3 SM 716 602 00, in
the amount of $42,602.00 is hereby released.
7. Neither acceptance of said improvements by the City Council ;
of the City af Encinitas nor this notice constitutes a waiver
of any defects. in the work af the constructa.on or install.ation
of said improvements.
