1. Pursuant to the Subdivision Map Act of the State of California ~
and Tit1e 24 of the Encinitas Municipal Code, Quail Gardens
Associates II, Ltd., a subdivider, did on the 11th day of January,
1984, enter into an agreement with the Gounty of San Diego to
construct and install certain improvements in that certain
subdivision known as Quail Gardens Unit 4, Tentative Map No. 4265,
Record Map No. 10817, said improvements coiisisting of street
improvements in the City of Encinitas.
2. Said agreement, including the plans and specifications for said
improvements, is on file in the affice of the Clerk of the City of
Encinitas.
3. Said improvements were completed and accepted by the Encinitas
City Council on the 23rd day of January, 1991.
4. SECURImIES: Securities for- warranty of wnrk are in the form
of a bond and are provided by:
Developers Insurance Company

Bond # 1.06954 Public Improvements (on site) $122,740.00
Bond # 106952 Public Improvements (aff site) 43,035.00
These bonds shall remain on file with the City for a period af one
year From the abave acceptance date (Item 3).

this notice c;onstitutes a waiver of any defECts in the work cf the
construction or installation of said improvemerits.

Quail Gardens, Unit 4; East of Saxony Road, South of La
Costa Ave., Leucadia (Degan Development)
. BACKQROUNA:
On January 11, 1984, the County of San Diego entered into an
aqreement with Quail Gardens Associates II, Ltd., for construction
of public improvements as a condition of approval of the Final Map
for Traat No. 4265. The final map was appraved by the County of San
Diego and Xecorded as Map Ivo. 10817 on January 12, 1.934.
The subdivxsion, now under the jurisdiction of the City, is a
planned development consisting of 153 single family residential
lots, 4 private street 14ts, 3 open space lots and a total acreage
of 80.0 acres. The subdivision is located in the Leucadia area
abutting Saxony RQad one-ha].f rnile north of Normandy Avenue. A
plat of tha subdivision is shown in Exhibit A.
DISCUSSION:
All public improvements have been campleted ta the satisfaction of
the City Engineer and are in aonformance with the improvement plans
approved by tkxe County Engineer. :
RECOMMENDAT I ON :
Tt is recommended that the City Council tdke the following actions:
1. Accept into the publialy maintained system the pub].ic
improvements as shown on the improvement plans tor Gounty of
San Diego Tract No. 4265.
2, Authorize the City Clerk to rec;ord a Nctice of Gompleicion witr,
the County Recorder for the pulalic improvement.s being accepted
at this time.
