1. Pursuant to the Subdivision Map Act of the State of California
and Title 24 of the Encinitas Municipal Code, The Highlands of
Encinitas, a subdivider, did on the 13th day of July, 1989, enter
into an agreement with the City of Encinitas to construct and
install certain improvements in that certain subdivision known as
The Highlands of Encinitas, Tentative Map No. 87-006, Record Map
No. 12433, said improvements consisting of street improvements in
the City of Encinitas.
2. Said agreement, including the plans and specifications for said
improvements, is on file in the Office of the Clerk of the City of
Encinitas.
3. Said improvements were completed and accepted by the Encinitas
City Council on the 22nd day of May, 1991.
4. SECURITY: Security for warranty of work is in the form of
Certificates of Deposit provided by San Diego Trust and Savings
Bank, 925 West Mission Road, Escondido, CA 92025. The amount of
the Certificates of Deposits is as follows:

The security for grading may be released in its entirety at this
time. The security for public improvements has already been
reduced to 25% of its original amount therefore, it shall remain
on file with the City for one year after the above acceptance date
(item no. 3).

5. Neither acceptance of said improvements by the City Council nor
this Votice constitutes a waiver of any defects in the work of the
construction or installation of said improvements.
