1. Pursuant to the Contract tor Stonesteps Beach Access
Repair Project, J. C. Baldwin Construction Company did enter into
an agreement with the City of Encinitas for demolition and removal
of specified p4rtions of existing wood stairs and foundation; and
rebuilding the foundation and wood stair as specified.
2. Said agreement, including plans and specifications for saa.d improvements, is on file in the Office of .the City Clerk of
the City of Encinitas. 3. The name of the surety on the Contractor's bonds
guaranteeing canstruction of said improvements and the payment of
labor and material therefore is Merchants Bonding Company Mutual,
3465 Camina Del Rio South, Suite 310, San Diego, CA 92101 with
policies issued on May 7, 1991.
4. Said improvements were completed and accepted by the
Encinitas City Council on the 21st day of August, 1991.
5. Perfariaance Bond, Number CA 215_ 11, in the amount of '
$44,680 is hereby released on September 26, 1991. ;
6. Labor ar_d Material Payment Bond, Numbex CA 215391, in the
amount of $44,680 is hereby released on September 26, 1991.

7. Neither acc.eptance of $aid impravements by the City
CounciI nor tha.s notice r.onstitutes a waiver of any defects in the '
raork of the construation or installatian of said improvements.
