l. Pursuant co the Subd ivision Map Act of the State of California
and Division 1 of Title 8of the San Diego Courty C'cx9e, Harry L. Summers,
Inc., a subciivider, did on the 14th day of Derember, 1983, enter into sn
agreement with the County of San Diego to construct and install certain
improvements in that certai.n subdivision known as TenCative Map 3897-4,
Recor.d Map No. 10800, said improvements ccnsisting o[ street and drainage
impi-ovements for Vista Del Rio Encinitas Unit #4.
2. Said agreement, including the plans and specifications for said
improvements, is or, file in the oEf.ice of tne Clerk of the aoard of
Supervisors of the County of San Uiego as Document No. 657955.
3. 5aid improvements we re cumpleted and accepted by the City
Council of the City o£ Encinitas on the 9th day uf Gecember, 1986.
4. The name of the suret;r on the subdivicier's Bonds guaranteeing
construction of said imprnvements arn9 the payment of labor an(' material
therefor is The American Insurance Company, c/o The Mills Company, 3505
Cedar Springs, Dallas, Texas 75219.
5. Improvement Bond #5233258 in the amount of $418,850.00.
Improvement portion: $410,850.00. On March 28, 1986, the County
Department ot Publ:c Works teduced this portion to $41,085.00. This
poJ-tion should be released at the end o[ the one-year warranty period.
Monumentation portion $8,000.00 is hereby reieased. Sewer Improvement Bond
#5233258-1: $54,850.00; this amo:ant was reduced to $5,485.00 on March 28,
1986 bil Public Works. This amount should be releaseci at the end of the
one-year warranty period.
6. Labor and Materia? Bond #5233258 in the amount of $209,425.00 and
Sewer Labor and Material Bond #5233258-1 in the amount oE $27,425.00
should bath be released in six (6) months should no claims be filed
against them.
7. Neither acceptance of eaid improvements by the City Council of
the City of Encinitas nor this notice constitutes a waiver of any defects
in the work of the constri.iction or installation of said impruvements.
