I. Pursuant to the Subdivision Map Act of the State of California and Title 24 of the Encinitas Municipal Code,
Encinitas Country Village Partnership, a subdivider, did on the 14th day of May, 1986, enter into an agreement with
the City of Encinitas to construct and install certain improvements in that certain subdivision known as Encinitas
Village, Tentative Parcel Map No. 4212-1, Record Map No. 10811, said improvements consisting of street improve-
ments in the City of Encinitas.
2. Said agreement, including the plans and specifications for said improvements, is on file in the Office of the
Clerk of the City of Encinitas.
3. Said improvements were completed and accepted by the Encinitas City Council on the 10th day of February,
1988.
4. The name of the surety on the subdivider's Letter of Credit guaranteeing construction of said improvements
and the payment of labor and material therefore is Mercury Savings and Loan Association, '7812 Edinger Avenue,
Huntington Beach, CA 926477.
5. Letter of Credit: $151,290.00. Street improvement portion is $55,600.00; 90% ($50,040.00) is hereby
released and the remaining 10% ($5,560.00) should be released at the end of the one-year warranty period. Monu-
mentation portion $2,200.00 is hereby released.
Labor and Material portion $93,490.00 should be released in six months should no claims be filed against it.
7. Neither acceptance of said improvements by the City Council nor this notice constitutes a waiver of any
defects in the work of the construction or installation of said improvements.
