1. Pursuant to the Subdivision Map Act of the State of California
and Title 24 of the Encinitas Municipal Code, Esposito Development
Company, a California limited partnership, a subdivider, did enter
into an agreement with the City of Encinitas dated January 12, 1988
to construct and install certain improvements shown on Plan No. TM
4563, in that certain subdivision :mown as Monte Mira Tentative
Map No. TM4563, Record Map No. 12012, said improvements consisting
of street improvements in the City of Encinitas.
2. Said agreement, including the plans and specifications for said
improvements, is on file in the office of the Clerk of the City of
Encinitas.
3. Said improvements were completed and accepted by the Encinitas
City Council on the 25th day of January, 1989.
4. The name of the surety on the subdivider's letter of credit
guaranteeing construction of said improvements and the payment of
labor and material is:
Farmers and Merchants Bank

Long Beach, CA 90802
5. Security
Letter of credit in the amount of $1,101,885 from Farmers
and Merchants Bank dated January 5, 1988. Street
improvement portion is $731,590; 75% ($548,690) is hereby
released. The labor and material portion in the amount
of $370,295 is hereby released. The remaining 25%
($182,900) to be released at the end of the one year
warranty period.
