Fieldstone Company, subdivider, did on the 13th day of
February, enter into an agreement with the City of Encinitas to
construct and install certain improvements in that certain
subdivision known as Tentative Map No. 4304-8, Record Map No.
11143, said improvements consisting of street and drainage
improvements in the City of Encinitas.
2. Said agreement., including plans and specifications for said
improvements, is on file in the office of the Clerk of the City
of Encinitas.
3. The name of the surety on the subdivider's Bonds
guaranteeing construction of said improvements and the payment
of labor and material therefore is The American Insurance
Company, 17542 E. 17th Street, Tustin, CA 92680.
4. Said improvements were completed and accepted by the City
Council of 'the City of Encinitas on the 25th day of May, 1988.
5. PERFORMANCE BOND - Improvement Bond No. 7127261 in the
amount of $482,700.00 has been placed to guarantee performance.
The street, drainage, sewer and water facilities appurtenances
improvement portion of the bond is $474,700.00, 90%
($427,230.00) is hereby released and the remaining from
($47,470.00) shall be held for a period of one (1) year
the acceptance date in paragraph 4 unless further notified by
the City of Encinitas.
6. Monumentation portion of the bond in the amount of
$8,000.00 is hereby released.
7. Improvement Labor and Material Bond No. 712n7U261A sin the

amount of $241,350.00 may be released in six (6)
no claim be filed against it,
8. Neither acceptance of said improvements by the City Council
of the City of Encinitas nor this notice constitutes a waiver
of any defects in the work of the construction or installation
of said improvements.

guaranteeing construction of said improvements and the payment

4. Said improvements were completed and accepted by the City
Council of the City of Encinitas on the 25th day of May, 1988.
5. PERFORMANCE BOND - Improvement Bond No. 7127258 in the
amount of $786,980.00 has been placed to guarantee performance.
The street, drainage, sewer and water facilities appurtenances
improvement portion is $680,080.00, 90% ($612,072.00) is
hereby released and the remaining 10% ($68,008.00) shall be
held for a period of one (1) year from the acceptance date in
paragraph 4 unless further notified by the City of Encinitas.
6. Monumentation portion of the bond in the amount of
$12,200.00 is hereby released.
7. Drainage fees in the amount of $94,700.00 have been paid
and this portion of the bond may be released.
8. A cash deposit of $109,920.00 has been placed with the
County of San Diego Board of Supervisors for erosion work
control work. The trust guaranteeing to faithful performance
is $73,280.00; 90% ($65,952.00) of this amount may be released
immediately, and the remaining 10% ($7,328.00) should be
released at the end of the one year warranty period.
9. The trust guaranteeing payment to the contractors,
subcontractors, and persons furnishing labor and materials is
$36,640.00. This portion of the cash deposit should be
released in six months should no claim be filed against it.
10. Improvement Labor and Material Bond No. 7127258A in the
amount of $346,140.00 may be released in six (6) months should
no claim be filed against it.
