1. Pursuant to the Contract for Encinitas Viewpoint Park
Improvements Project, awarded to Excel]. Landscapinq
Inc. did on the eighth day of December 1988 enter
inta any agxeement with the City of Encinitas ta
construct certain improvements indicated in contract
documents, said improvements consisting of park
expansion resulting in an open play £ield, walkways,
playgrcund and a raater conservatian irriyation
system.
2. Said aqreement, including plans and specifications
for said improvEments, is on file in the office of
the City Glerk of the City of Encinitas.

3. The name of the surety on the Contractor's bonds
guaranLeeing construction of said improvements and
the paymerit of labor and material therefore is Galden
Eagle Insurance conpany, with policies issued on
December 20, 1988.
4. Said improvements were completed and accepted by the
City Cosncil of the City of Encinitas on 14th day of
June, 1989. ~
5. Performance Bond, Nur.iber SUR 084411, in the amount of
$111,283.20 is hereby released on June 29, 1989.
6. Labor and t4aterial Paymcnt Bond, Number SUR 084411,
in the amount of $111,283.20 is hereby released on
June 29, 1989.
7, Neither acceptance of said impravements by the City
Council af 'che city of Encinitas nor this notice
constitutes a wa.iver of any defe:.ts in the work of

and Title 24 uf the Encinitas Municipal Code, Pieri-Debbas
Enterprises, a Ger.eral Partnership, a subdivider, did on the 25th
day cf February, 1986, enter into an agreemerit witli the County of
San Diego, to construct and install certain improvements shown on
Plan No. TM4503-1 in that certain subdivision known as Cardiff-by-
the-Sea Apartments, Tentative Map No. TM4503, RECOrd Map No. 11455
and 11485, said improvements consisting of street improvements in
the City of Encinitas.
2. Said agreeMer.4, including the plans and specitications for
said improvements, is on file in the Office of the Glerk of the
City of Encini'tas.
3. Said improvements were completed aiid accepted by the Encinitas
City Council an the 12th day of April, 1989.
4. The name of the surety on the subdivider's bonds guaranteeing
constructio!. of said improvements and the payment of labor and

5. The name of the surety on the sLtbdivider's Letter of Credit
guaranteeing constrizcticn of Erosion Control Work is California
