1. Pursuant to the Con~.ract for Cardi.ff-By-The Sea Sports-k No FE
Project, awarded to Marina Contractors, Incorporated, did on the
i eighth day of March 1989 enter into an agreement with the City of
Encinitas to construct certain improvemen'ts indicated in contract
documents, said impr.ovements consisting of constructing a sports
park tTith all amenities.
2. Said agreement, including plans and specifications for said
improvements, is on fils in the Office of the City Clerk of the
City of Encinitas.
3. The name of the surety en the Contractor's bonds guaranteeing
construction of said improvements and th.e payment of lapor and
naterial therefore is Continental Insurance Company, with policies
j issued on March 6, 1989.
i 4. Said impro-tiements were coMpleted and accepted by the City
~ Council of the City of Encinitas on the 13th day of December 1989.
I 5. Perforxnance Bond, Number 158 85 15, in t'ae amount of
$921,931.00 is hereby released on January 18, 1590.
6. Labor and Material PaymPnt Bond, Number 158 05 15, in the
anount of $921,931.00 is hereby released on Januar,r 18, 1990.
7. A Bond in the amount of $10,000 will be posted for tNelve
months for guarantee of turf establishment. The bcnd will remain
in force until November 9, 1990.
8. A Bond in th.e amcunt of $5,000 will be posteci Lztil the fI eld
lighting is adjusted and meets all specifications o--- the contract. ~
This bond will remain in foxce until May 31, 1990.
g. Neither acceptance of said improvements by the City Council
of the City of Encinitas nor this notice constitutes a wai.ver of
~ any defects in the work of the constructi.on or insta:.lation of sz zd
