1. Pursuant to the Subdivision Map Pct of the State of Caii.fornia
and Title 24 of the Enci-nitas Municipal Code, Ralph E. Luedtke and
Va Dona Luedtke, suhdividers, dia on the 8th day of January, 1988,
enter into an agreement with the City of Encinitas to construct and
install certain public improvements shown on Plan No. TM 4603 in
that certain subdivisior known as Manaco Subaivision Recorded Map
No. 12049, said public improvements consisting of stree'-
improvements in the City of Eiicini'tas.
2. Said agreement, including the plans and specificatien2 for
said public improvements, is on file in the office of che City
clerk,

3. Gn January 24; 1990, public improvements as outlined pelow
were accepted by City Council:
Local.ized widening of Rubenstein Avenue at project frontage.
4. Security:
Security for warranty of work is in the form of a letter of
credi.t, provided by California Commerce Bank, P.O. Box 390, San
Diego, CA 92112. The amount on this Letter of Credit may, at this
time, ue rECluced by $1, 800 to $343, 400. The reductiori in security
is foi completion and acceptance of public impravements on
Rubenstein ,Avenue. The remai.ning amount on the Letter of Credit
covexs 23% of cost es::imate fcr public improvements and 150% of
cost estimate f(,r prz.rate improvements.
The remaining amcunt oil the Letter of Credit pertaining to
public improvements ($360) shall remain in a file with the City for
onP year after the above acceptance date (:item No. 3).

5. Ideither acceptance of said improvements by City Counail nor
