1. Pursuant to the Supdivision Map Act of the State of California
anci Title 24 of the Encinitas Municipal Code, Scotts Valley, a
Califarnia General Partriership, did on the 17th day of August,
1987, enter into an agreement with the City of Encinitas to
construct and install certain improvements shown on Plan No. TM
4579-1 in that certain subdivision known as Scotts Valley, Record
Map No. 11921, said improvements consisting of street and drainage
impravements in the City of Encinitas.
2. Said agreement, including the plans and specifica.tions for said
improvements, is on file in the Office of the Clerk af the City of
Encinitas.
3. Said improvements were completad and accepted by the Encinitas
City Council on the 27th day of September, 1989.
4. The name of the surety on the subdivider's Bond guaranteeing
construction of said impravements and the payment of labor and
material is American Insurar,ce Ccmpany, c/o GAF Ins.urance Service,
P.O. Box 85410, San niego, CA 92138, Attention Ms. Chris Patterson.
5. Security
A. Construction of Improvements
Bonds guaranteeing conztruction of improvements from the
American Insurance Company (Bond No. 731 63 63) as
follows:
Bond amount $1,224,950.00
Street, drai.nage and sewer
improvement $1,120,000.00
Portion (to be retained)

The retained amount shall remain with the City for one year
£ollowing the acceptance of work by City Council and until such
time that the City k*ill require the security.
E. Payment of Labor and Material
Bonds guaranteeing payments for labor and material in the
amount of $564,075 from American Insurance Company (Bond
No. 731 63 63). This bond is to be released six months
after the above date uf acceptance of improvements by the
City Council.
6. Neither acceptance of said improvements by the City Council
nor this notice constitutes a waiver of any defects in the work of
the construction or installation of said improvements.
