Pursuant to the Subdivision Map Act of the State of California
and Title 24 of the Encinitas Municipal Cbde, Moonli.ght Cove,
Ltd., a subdivider, did on the 13th day of April, 1987, enter
into an agreement with the City of Encinitas dated April 13,
1987 to construct and install certain improvements shown on
Plan No. TM 4561-1 in that certain subdivision knowii as
Moonlight Cove, Tentative Map No. 4561-1, Record Map No,
11795, said improvements consisting of street improvements in
the Gity of Encinitas<
2. Said agreement, including the plans and specifications for
said impxovements, is on file in tr:.E fice of the Clerk of
'the City of Encinitas.
3. Saicl improvements we.re completcd and accepted by the Encinitas
City Council on the 16th day of November, 1988.
4. The name of the surety on the subdivider's surety bond
guara7teeing constructinn of said improvements and the payment
of lalaor and material is the Insuranc-e Company of the West.
5. Security; Type: Surety Liond for faithful pexformance, Amaunt
$669,100 from The ?nsurance Ccmpany nf the West dated March
23, 1988. Streei: improvement partion is $669,100; 90%
(5602,190) is herPby relhased arid the remaining 10% ($66,910)
bs relsased at the end of thQ one-year warranty pariod.
6. Security: Type: Surety Bond for Lahor and Materials, Amount
$334,550 from The Insurance Company uf the West clated March
23, 1988. Street improvements portion is $334r550; 100%
($334,500) is hereby xeleased.

7. Neither acceptance of said improvements by the City Council
mor, this natice constitutes a waiver of any defects in the
work of the construction, design or installation of said
impravements.
