Project, awar.ded to Marina Contractors, Incarporated, did on the
eighth day of March 1989 er.ter into ar, agreement with the City of
Encinitas to cor.struct certain improvements indicated in contract
dacuments, said improvements conuisting of constructing a sports
park caith aJ.l amenities.
2. Said agreemznt, including plans and specifications for said
improvements, is on file in the Office of the City Clerk of the
City of Encinitas.
3. T:ie name of the surety on the Contractor's bonds quaranteeir.g
construction of said improvaments and the payment of labor and
materiai therefore is Cnntinental Insurance Company, with policies
issued on March 6, 1989.
4. Said improvemerits were completed and accPpted by the City
Council of the City of Encinitas on the 13tn day of December 1989.
5. Performance l3ond, Nizmber 158 85 15, in tze amount of
$921,931.00 is hereby released on January 18, 1950.
6. Labor and M«terial Payment Bond, Numher 158 85 15, in thQ
amount of $921,931.00 is hereby rel2ased an Januarv 18, 1990.
7. A Bcnd in tre amount of $10,000 will bP posted far twelve
months for guarantee of turf establishment. The bcnd wi].1 remain
in foxce until November 9, 1950.
8. A Bond in the amount of $5,000 will be posted until the tield
lightina is adjusted and meets all specifications of the contract.
Tliiis bond will remain in force until May 31, 1990.
9. Neither acceptance of said improvements by the City Council
of the City of Encinitas nor this notice constitutes a waiver of
any defects in thework of the construction or installation of said
improvements.
