1. Pursuant to the Subdivision Map Act of the State of Caliiarnia
and Title 24 0f the Encinitas Municipal Code, Ralph E. Luedtke and
Va Dona Luedtke, subdividers, did on the 8th day of Januaryo 1988,
enter into an agxeement with the City of Encinitas to construct and
inst•.all certain public improvements shown on Plan No. TM 4603 in
that r.ertain subdivi:;ion knawn as Monaco Subdivision Recorded Map
No. 120491, said public improvements coiisisting of street
improvements in the City of Encinitas.
2. Said agreement, inclu3ing the plans and specifications for
said public i.mprovements, is on file in the office of the City
Clerka
3. On January 24, 1990, psblic improvements as autli.ned below
wsre accepted by City Council:
Localized widening of Rubenstein Avenue at project frontaye.
4. Security:
Secizrity for warranty af work is in the form of a letter of
credite provided by Califarnia Commerce Bank, P.O. IIox 390, San
Diego, CA 92112. The amount on this Letter of Credit may, at this
time, be rec.-ced by $1,800 to $343,400. The reduction in security
is for cflmpletion and acceptance of public impravements an
RL~benstein Avenue. The remaining amount on the Latter of Credit
covers 25% of cost esti.mate for public improvements and 150% of
cost estimate for pri-vate imr~rovements.
The remaining amount an the Letter of Credit pertaining ta
public improvements ($360) sha11 remain in a file with the City f4r
one year after the above acaeptance date (Item No. 3).
