1. Pursuant to the Subdivision Map Act of the State of California and Title 24 of the Municipal Code
of the City of Encinitas, G&S/TS, Ltd., subdivider, did, on the 23rd day of December, 1994, enter into
agreements with the City of Encinitas (CITY hereinafter) and the Encinitas Sanitary District (DISTRICT
hereinafter), CITY being successor in interest to DISTRICT, to construct or install certain improvements
for that certain subdivision known as Ocean View Estates, Tentative Map No. 89-196, record Map No.
13179, said improvements consisting of public road, drainage, and sewer improvements in the public
rights-of-way of Via Linda Del Sur, Calle de Adele, Ocean View Avenue, Via Julita, and in a certain
public drainage easement more particularly described in that document recorded December 8, 1994,
Document No. 1994-0703205, Official Records.
2. Said agreement, including the plans and specifications for said improvements, is filed and
available for public viewing in the offices of the City Clerk and Director of Engineering Services, the plans
of which are labelled Drawing Nos. 3385-1 and ES-1149.
3. Said improvements were constructed by the subdivider and completed by August 27, 1996. Said
improvements were accepted by the City Council on _ January 29 , 1997.
4. The subdivider did post performance bonds and letters of credit to guarantee construction of said
improvements. The issuing financial institutions are Insurance Company of the West and First Interstate
Bank of California (now Wells Fargo Bank).
5. Security deposit: $349,594.00. The Letters of Credit, in the cumulative amount of $69,918.00,
have been released. The Performance Bonds, in the cumula, ive amount of $279,676.00, have been reduced
to $87,398.50. The reduced value is the sum of warranty retentions guaranteeing remedies to defects in
construction discovered during the one-year warranty period. Bonds in place and in the reduced amounts of
$77,099.75 and 510,298.75 guarantee public road and drainage work, and public sewer work, respectively.
Said Bonds shall be exonerated upon termination of said warranty period and satisfactory conclusion of a
warranty inspection.
6. Neithei acceptance of said improvements by the City Council nor this Notice constitutes a waiver
of any defects in the work of the construction or installation of sa;d improvements.
