I. Pursuant to the Subdivision Map Act of the State of Califomia and Title 24 of the Municipa! Code
of the Ciry of Encinitas, Requeza Properties, sub8ivider, did, on the 23rd day of Nevember, 1992, enter
into agreemeats with the Ciry of E►icinitas {CITY hereinsfter} and the Encinitas Sanitary District
(DISTRICT hereinafter), CITY being successor in interest to DISTRICT, to construct or install Gertain
improvements for that certain subdivisi,)n icnown as Pelican Ridge, Tentative Map N9. 84-272, record tvfap
No. 13006, said improvements consisting of pu5lic road, drainage, and sewer improvements in the puhlic
rights-of-way of Ca1!e Magdalena and Requsza Sereei, and in cer€ain public sewer easements more
particularly described on said Map and in those documents recorded November 23, 1992 and January 29,
1956, Dncument Nos. 1992-0751362 and 1996-0042436, respectively, Official Records.
2. Said agreement, including the pfans and specifications for said improvemPnts, is filed and
available for public viewing in the offices of the City Clerk and Director of Engineering Services, the plans
of which are label3ed Drawing Nos. 1183-R and ES-109.
3. 5aid improvements weTe constructed by the new proper-ty owner, Fairfield/Ercinitas-1$, L[d., and
completed by August 20, 1996. Said improverrzents were accepted by the Ciry Council on January
29 , 1997.
4. The subdivider did post performance bonds and cash deposit to guardntae construction ef said
improvements. The issuing surety is Insurance Compaey of the West.
5. Securiry deposit: $65,930.20. The Cash Deposit, in the cumulative aniount of $12,130.20, has
been refundecl. The Performance Donds, in the cumulative amount of $53,800.00, have been reduced to
$16,482.55. 7'he reduced value is the sum of wan•anty retentions guaranteeing remedies to defects in
coitstruction discovered during the one-year warranry period. Bonds in place and in the reduced amounts of
S1,590.05 and S14,892.50 guarantee publ:c road and drainage work, and public sewer work, respectively.
Said Bv;ids chall be exonerated upon termination ol' said warranty period and satisfactory conclusion of a
warranry inspection.
6. Neither acceptanee of said improvements by the City Council nor ihis Notice constitutes a waiver
of any defiocts in the work of the conse;vction or mstailatiori of said improvements.
