. 1. Fursuant to the Svbdivision hIap Act of the S:ate of
California and Title 2^ of the F.ncini.tas Municipal CodF,
Multitech Properties, Inc subdivider, did on the 4th day of
Decenber, 1985, eater into an agreement with the City of
F.ncinitas to construct and install certain improvements in that
certain suodivision knoo:n as Tentativ2 Map Pio. 4496-1, 12ec;ord Map
No. 11.380, said improvements cor.sisting of street 2rid drainage
zmprovements in ttie City of E;nciiiitas.
2. Said aqreement, includiny plans and specifications for said
inprovements, is cn file in the office of the Clerk of the City
of Encinitas.
3. The r.at*te of the. surety cn 'l-, subdivider's Bonds guaranteeiny
construct'-on of said improvements and the payment of lahor. ar.d
material therefore is Developers Insurance Company, P.O. BoY
3343, Anaheim, California, 92803.
4. Said improvements were completed and accepted by the City
Council of the City of Encinitas or the 26th day oY October,
1987.
5. Per?:ormance Bond - Improveme:lt Bond "9iur-055 in the amou>>t
of $68,600.00; 90% ($61,740.00) iz; hereby :eleased and the
remaining 10% (S1-6,8E0.00) sha17_ be held for a per.iod of or.e (1)
year Fron the zcceptance date in paragr.apn 4 abovF unless fur.ther
r.otified by the City.
6. Improvement Labor and Mat:eria' Bond #9166055 the amount of
$34,300.00 may released in six ;G} months should no ctaim be
fi]_ed against them wiLh the City of F.ncinicas.
7. Neither acceptancA of said imprevements by the City Council
of the City of Ericinitas nor this nor=ce constiti.ttes a waiver of
any defects in the work of the construction or installatian of
said improvements.

1986, the subject property is now within its jurisdiction.
On December 9, 1986 the City of Encinitas accepted the
imp;:ovements for e,aid projects, resolution enclosed.
Also encloEed are copies of the Notices oF Completion recorded
by the County of San Diego on behalf o` said City. Please note
paragraph's No. 5 and 6 which states how the Bonds are to be
released.
