1. Pursuant to the Subdivision Map Act of
California and Title 24 of the Encinitas Municipal Code, The
Fieldstone Company, subdivider, did on the 13th day of
February, enter into an agreement with the City of Encinitas to
construct and install certain improvements in that certain
subdivision known as Tentative Map No. 4304-7, Record Map No.
111:3, said improvements consisting of street and drainage
improvements in the City of Encinitas.
2. Said agreement, including plans and specifications for said
improvements, is on file in the office of the clerk of the City
of Encinitas.
3. The name of the surety on the subdivider's Bonds
guarante.aing construction of said improvements and the payment
,of labor and material therefore is The American Insurance
Company, 17542 E. 17th Street, Tustin, CA 92680.
4. Said improvements were completed and accepted by the City
Council of the City of Encinitas on the 25th day of May, 1988.
5. PERFORMANCE BOND - Improvement Bond No. 71.27260 in the
amount of $321,314.00 has been placed to guarantee performance.
The street, drainage, sewer and water facilities appurtenances
improvement portion is $3'_4,010.00, 90% ($252,609.00) is
hereby released and the remaining 10% ($31,401.00) shall be
held for a period of one (1) year from the acceptance date in
paragraph 4 unless further notified by the City of Encinitas.
6. Monumentation portion of the bond in the amount of
$7,300.00 is hereby released.
7. Improvement Labor and Material Bond No. 7127260A in the
amount of $160,655.00 may be released in six (6) months should
no claim be filed against it.
8. Neither acceptance of said improvements by the City Council
of the City of Encinitas nor this notice constitutes a waiver
of any defects in than work of the construction or installation
of said improvements.

I, DEBORAH CERVON.., DEPUTY CITY CLERK of the -ty of Encinitas,
a political subdivision of the County of San Diego, State of
California, which is the owner of the public work described in
the within Notice of Completion executed by said City of
Encinitas, do declare under penalty of perjury that I have read
the same and know the contents thereof and that the facts
therein stated are true of my own knowledge. I make this
