1. Pursuant to the Subdivision Map Act of the State of California
and Division 1 of Title 8 of the San Diego Counl-y Caje, McMillin
Development Company, a subdivide:, clid on the 26th day of August, 1980,
enter i.nto an ayreement with the County of San Diego to construct and
install certain improvements in that certain suhdivision known as
Tentative Map 3474-2, Recorc9 Map No. 9780, said improvements consisr_ing of
street and drainage improvements.
2. Said agreement, includiny the plans and specifications for said
improvements, is on file in the office of the C1erk oE the Board of
Supervisors of the County of San Diego as Document No. 609824.
3. The name of the surety on tr,e sutxlivider's bonds guaranteeing
construction of said improvements and the payment of labor and material
therefor is The American Insurance Company, P.O. Box 808, San Diego,
California 92112.
4. Said improvements were completecl and acc:epted by the City
Council o£ the City of Pncinitas on the 20th day of October, 1986.
5. Perf.ormance Bond - Improvement Bond #731 05 28 in the amount of
$693,300.00; 90% ($623,970.00) is herehy released and the remaining 10%
($69,330.00) shall be held for a perioc] of one (i) year from the
acceptance date in paragraph 4 above unless further notified by the City.
Sewer Improvement Aond #731 05 31 in the amount of $199,400.00; 90%
($179,460.00) shall be held for a period of one (1) year from the
acceptance d ate in parag~-aph 4 above unless further notified by the City.
6. Improvement Labor and Material Bond #731 05 28 in the amourit of
$503,500.00 and Sewer Labor and Material Bond #731 05 31 in the amount of
$99,700.00 may be released in six (6) months should no i:laims be filed
against them with the City of Encinitas.
7. Monumentation dond #731 05 29 in the amount of $10,250.00 is
hereby released. Par% Land Security Bond #731 05 27 in the amount of
$17,400.00 has been released.
8. Neither acceptance of said improvemenL-s by t.he C:.ty Council of
the City of Encinitas nor this notice constitutes a waiver of any defects
in the work of the construction or installation of said improvement.s.
