1. Pursuant to the Suod ivision Map Act o!' the State of Cal ifornia
ancl Division 1 of Ti.tle 8 of the San Diego County Code, Harry L. Summets,
Inc., a subdivider, did on the 14th day of December, 1983, enter ir;to an
a-ireement with tht County of San Dieqo to construct and install certain
improvements in that certain subdivision known as Tentative Map 3897-4,
Record Map No. 10800, said improvements consisting of street and drainage
improvements for Vista Del Rio F.ncinitas Unit #4.
Said aqreement, inc.luding the plans and specifications for sai.d
improvements, is on file in the office of the Cleri of the Board of
Supervisors ot the County of San Aiego as DocumenY No. 657955.
3. Said improvements were coaipleted and accepted by the City
Council of the City of Encinitas on the 9th day of December, 1986,
4. The name of the surety on the subclivi(9er's Bonds guarant-ing
construction of said improvements and the payment of labor and material
therefor is The American `nsurance Company, c/o The Mills Company, 3505
^.edar Springs, Dallas, Texas 75219.
5. Improvement Bond #5233258 in the amount of $418,850.00.
Improvement portion: $410,850.00. On March 28, 1986, the Coilnty
DepaT-tment of Public Works reduced this porr.ion to 541,085.00. This
portion should be released at the end of the one-year wa:-ranty period.
Monumentation portion $8,000.00 is hereby released. Sewer Impzovement Bond
#5233258-1: $54,850.00; this amo•int was reduced to $5,485.00 on March 28,
1986 by Public Works. This amount should be releaseci at the end of the
one-year warranty period.
6. Labor and Material Bond #5233258 in +:he amount of $209,425.00 and
Sewer Labvr and Material Bord #5233258-1 in the amount of $27,425.00
should both be released in six (6) montYis should no claims be filed
against them.
7. Neither acceptance of said improvements by the City Council of
the City of Encinitas nor this notice constitutes a waiver of any defects
in the work of the construction or instal]ation of said improvements.
