agr.eement with the County of San Dieqo to construct and install certain
improvements in that certain sUbdivision known as Tentative Map 3897-3,
Re,:or:i Map No. 10799, said improvements consisting of street and drainage
i improvements for ViGta Del Rio Encinitas Unit #3.
2. Said agreement, including the plans and specifications for said
improvements, is on file in the office of the Clerk of the 13oard of
Supervisors of the County of San Dieyo as Document No. 657954.
3. Said improvements were completed and accepted by the City
Council of the Cit of Encinitas on the 9th day of December, 1986.
4. The name of the surety on the sulxlivider's Bonds guaranteeing
constructi.on of said improvements and the payment of labor and mate:-ia1
therefor is The Ar^rican Insurance Company, c/o The Mills Company, 3505
Cedar Springs, Dallas, Texas 75219.
5. Improvement Boiid #5233257 in the Gmount of $335,850.00.
Improvement portion: $325,850.00. On March 28, 1986, the County
Departmei.t of Public Works redu^ed this portion to $32,585.00. This
portion should be released at the end of the one-year warranty periai.
Monumentatiori portion $10,000.00 is hereby released. Sewer Impiovement
Bcnd #5233257-1: $111,050.00; this amount was reduced to $11;105.00 on
March 28, 1986 by Public Works. This amount shoi:ld be released at the end
of the one-year warranty peric..i.
6. Labcr and t4ateiial Rond #5233257 in the amount of $167,925.00 and
Sewer Labor and Material Aond #5233257-1 in the amount of $55.525.00
should both be released in six (6) months should no claims be filed
against them.
