1. Pursuant to the Subdivision Map Act of tie State of Cali`ornia
and Divisian 1 of Title 8 of the San Uiego County Code, Harry L. &-mers,
Inc., a subdivider, did on the 5th day of January, 1983, enter into an
agreement with the County of San Dieyo to construct an(7 install certain
improcements in tliat certain suhdivision known as Tentative Map 3897-1,
Record Map No. 10556, said impr,jvemznts consistiny of street and arainage
improvements for Vista Del Rio Encinicas Unit #1.
2. Sa:d agreement, including the plans and specifications for said
improvements, is on file in the office of tht Clerk of the Board of
Supervisors of tne County of San Diego as Document No. 646430.
3. Said improvements were completed and -iccepted by the City
Council of the City of Encinitas on the 9th day of Deceniber, 1986.
4. The name of the surety on the subdivider's Bonds guaranteeing
construction of said improv2ments and the payment of labor and material
therefor is The American Insurance Company, c/o The Mills Company, 3505
Cedar Springs, Dallas, Texas 75219.
5. Improvement Bond #5222299 in the amount of $664,1G0.00.
Improvement portion: $654,700.00. On March 28, 1986, the County
Departnent of Public Werks reduced this portion to $65,470.00. Tnis
portion should be released at the end of t:ie one-year warranty period.
Monuiaentation portion $6,250.00 is hereby released and the drainage fee
portion #3,150.00 is hereby reieased. Sewer Improvement Bond u5222299-1:
$89,150.00; this amount was reduced to $8,915.00 on March 28, 1986 by
Public Works. This amount shoulci be released at the end of the one-year
warranty period.
6. La.bor atid Material Bond #5222299 in tne amount uf $327,350.00 and
Sewer Labor and Material Bond #5222299-1 in the amuunt of $42,640.00
shosld both be released in six (6) months should no claims be filed
against tizem.
7. Nei.ttier acceptance of said improvements by the City Council cF
