1. Pursuant to the Subdivision Map Act of the State of California
and Title 24 of the Encinitas Municipal Code, Warminaton Encinitas
Associates. LP,, a California Lintited Partnershi.p, a subdivider, did
eriter into an aqreement with the City of Enci:iitas to ^onstruct. and
install certain improvements in that subdivision known as Zentative
Map No. 89-033, Record Map No. 12582, said improvements consisting
of public street and drainage improvements in the City of
Encinitas.
2. Said agreement, including the plans and specifications fox
said improvements (9277R) , is on file in the Office Of tY1P. Cler.}c of
the Gity of Encinitas.
3. Said improvements were compl ted and accepted by the Board of
Directors on tha da1 of 1993•
4. The name of the financial institution on the subdivider's
Letter of Credit guaranteeing cor.struction of sai3 improvementa and
the payment of labor and material therefore is Bank of California.
5. Letter of Credi.t No. I-18697. Street and drainage
improvements are $301,875.00; 83•"s ($251,537.87) is hereby released
and the remaining 17% ($50,307.3', shall be released at the end of
the one-year caarranty period.
6. Neither acceptance of said a.mprovements by tY,e City Council
nor this Notiae constitutes a waiver of any defects in the work of
the construation or installation of said improvemsnts.
