1. Pursuant to t.he Subdivision Map Aat of the State of CalifArnia
and Titie 24 of the Encinitas Municipal Code, Byron tahite, a
subdivider, did an the 25th day of August 1987, ertter intn an
agreement with the City of Enainitas to canstruct and install
certain improvement in that certain subdivision known as Garden
View Plaza, Te.ntative Map No. 4255, Re.:ord Map No. 11909, said
improvements consisting of S*.rpet imprAvements in the City of
Encinitas.
2. Said agreement, including the plans and specifications for said
improvements, zg on fi1e in the Office of the Clerk of the City af
Encinitas.
3. Said improvemenfs were completed and accepted by the Enainitas
City Council on the 22nd day of Apr.Ll, 1392.
4. Security: Security for warranty nf work is i.n the fc--m of
letters of areait in the name of the Gity of Fncinitas. These
letters were isaued by Torrey Pines Bank which later mergad into
WeZls Fargo Bank, whirh is now the issuex bank.. The letters of
credit are as follaws:
