NOTICE OF COMPLETION
1. Pursuant to Title 24 of the Encinitas Municipal Code,
Nancy Hayward, a developer, did on the 23rd day of October,
1987, enter into an agreement with the City of Encinitas dated
November 10, 1987, recorder's File No. 87-650255, to construct
and install certain improvements shown on Plan No. CG3308 known
as Montessori School at 616 Old Highway 101, Major Use Permit
No. P86-059, said improvements consisting of street
improvements in the City of Encinitas.
2. Said agreement, including the plans and specifications for
said improvements, is on file in the office of the Clerk of the
City of Encinitas.
3. Said improvements were completed and accepted by the
Encinitas City Council on the 27th day of July, 1988.
4. The name of the surety on the subdivider's Letter of Credit
guaranteeing construction of said improvements and the payment
of labor and material is First National Bank of North County.
5. Security: Type: Irrevocable Standby Letter of Credit,
Amount $20,850 from First National Bank of North County dated
10-22-87. Street improvement portion is $20,850; 75% ($15,640)
is hereby released and the remaining 25% (5,210) to be released
at the end of the one-year warranty period.
6. Neither acceptance of said improvements by the City Council
nor this notice constitutes a waiver of any defects in the work
of the construction or installation of said improvements.
