CERTIFICATE OF COMPLIANCE
(Section 66499.35 of the Government Code)
IN COMPLIANCE:
The Planning and Building Director of the City of Encinitas has determined that the parcel of real
property described below has been divided or has resulted from a division in compliance with the
Subdivision Map Act and with the provisions of the City of Encinitas Municipal Code. The parcel
described herein may be sold, leased, or financed without further compliance with the Subdivision
Map Act or any local ordinance enacted pursuant to the Act. Development of the parcel may
require issuance of a permit or permits, or other grant or grants of approval.
Section 30.16.010 of the City of Encinitas Municipal Code specifies a minimum lot size of 1 net
acre and minimum lot dimensions of 150 feet in depth and 110 feet in width for the subject RRl
zone. The subject property, consisting of 1.796 net acres, is in compliance with zoning regulations.
This Certificate of Compliance applies to one parcel which is in substantial compliance with the
County of San Diego approved lot split 262-042-8, approved by the County of San Diego on April
16, 1970. The area in the northwest corner ofthe subject property differs from the county approval,
but other public records, including, but not limited to, City of Encinitas Certificate of Compliance
93-186 recorded as document 1993-0667019 on October 7, 1993 in the office of the County
Recorder provides sufficient evidence that the parcel is in substantial compliance with the
aforementioned entitlement.
Owner: Willard Earl Wheeler, Trustee of the Wheeler Qualified Personal Residence Trust

NOTE: The description and plat in Exhibits "A" and "B", attached, have been provided by the
owner of the property, and neither the City of Encinitas nor any of its officers or employees assume
any responsibility for the accuracy of said descriptions.
This Certificate of Compliance shall in no way affect the requirements of any City, County, State,
Federal, or local agency that regulates development of real property.
