1. Southland Cardiff Associates LLC did on the 8th day of May, 1997, enter into an "Agreement to
Improve Development - Water Facilities" with the San Dieguito Water District. The Agreement detailed
the requirements for the construction and installation of 1,450 feet of 8" pve water main within
MacKinnon Ranch Road in the City of Encinitas.
2. Said Agreement, including the plans and specifications for said improvements, is on file in the
Office of the Clerk of the Board of Directors.
3. Said improvements were completed by the O\V1ler and accepted by the San Dieguito Water District
Board of Directors on the 25th day of August, 1999.
4. Subdivision Bond No 3SM 909 500 00 from American Motorists Insurance Company in the
amount of $113,482.50 may be released at this time. The District will retain Miscellaneous Assignment
of Account No. 019200-0001 from Imperial Bank in the amount of$37,827.50 from Imperial Bank which
shall be released at the end of the one-year warranty period.
5. All requirements of said Agreement have hereby been satisfied except for warranty.
6. Neither acceptance of said improvements by the Board of Directors nor this Notice constitute a
waiver of any defects in the work ofthe construction or installation of said improvements.

SUBJECT: Consideration of Acceptance of Public Water Improvements and Authorization to
File a "Notice of Completion" for a Subdivision Developed by Southland Cardiff
Associates LLC, Located on Manchester Avenue (APN 261-290-01 to 30 and 261-
291-01 to 25).
BACKGROUND: On May 8, 1997, the San Dieguito Water District entered into an
" Agreement to Improve Development - Water Facilities" with Southland Cardiff Associates LLC,
O\Vl1er of property located on Manchester Avenue. The Agreement detailed the requirements for
the construction and installation of certain public water improvements.
ANALYSIS: The water improvements were installed in accordance with District approved plans
and specifications, under District inspection. District staff has no objections to filing the "Notice of
Completion." A 2S.percent retention of security will be held by the City of Encinitas Engineering
Services Department for one year to cover warranty of improvements.
FISCAL AND STAFF IMP ACT: Future expenses will be incurred for maintenance of the new
water improvements. Funds to cover the cost of said maintenance are collected through the sale of
water.
RECOMMENDATION: Accept Public Water Improvements and Authorize District Manager
to File a "Notice of Completion" for a Subdivision Developed by Southland Cardiff Associates
LLC, Located on Manchester Avenue (APN 261-290-01 to 30 and 261-291-01 to 25).
