1916-06-06 _ 4 ~ MINUTES OF A REGULAR MEETING OF THE BOARD OF DIRECTORS OF `IHE CARDIFF IRRIGATION DISTRICT, HEI,D AT THE OFFICE OF 'I'HE DI5- TRICT IN THE FLATIRON BUILDING IN CARDIF'F,SAPv DIEGO COUNTY, CAL- IFORNIA, NNE 6TH, 1916,AT TWO 0'CLC}CK P. M. Present: J. FRANK CULLEN, E. E. YOUNU, J. L. NiIN:dEY. The meetinZ was duly called to order by the president. the minutes of the previous meeting of May 2nd, 1916 were read and approved. The presibdent than called upon the secretary to ascertain if any communications had been received and. reported that a letter 4had been received from Mr. John Covert, irrigation engineer setting forth the terms upon which he would makc the examination, plans, surveys and reports to be used in connection Prith the prospective bond issue fbr the District -Dollars. The president was instructed to enter into a contract with said Ptr. Covert as per said letter. The Foll.owing bills were then presented and ordered paid. L.Ylinney, " 4.00 ~ The secretary reported to the Board of equalization held on May 24th, 1916, met to equalize assessments as required by the statute to-wit:-Section 38 of Act 1726 of the General Laws , of the State of California; Section 39 of said act requiring that within 15 days after the closing of its session as a Board of Equalization, levy an assessment sut'fcient to pay in full all sums due or that shall become due upon the district before the time for leving ths next annual assessment. The Board proceeded to discuss the levy. The president than stated thatthe Po1lowing amounts would be required between the date of this mee#,ing and levying of the next assessment as follows:- $2,000.00 Money borrowed from the Union Nat'1 Bank- to pay expenses, etc. - 3,000.00 On aecount of purchaling system from J.Frank Cullen- 1,500.00 Salarg of Engineer. 1,200.00 " " Treasurer, ~ 600.00 Interest. 400.00 Secretary. 7600.00 Attorney. 10000.00 Operating expenses. 360.40 Rent of office, 350.00 Furniture and fixtures, 1,646.00 Irri~ation Engineer for services 1,050.00 Option on lands and miscellenaous expenses. ; A total of $13,000.00 ~ ; The secretary reparted the total assessrnent for the District to be $500,528.00 and it w as found the amount necessary to ~ be raised after deducting 15% from the vrhole amount assessed w ich gives a levy of 32 cents on every dollar. . t E. E. Young then offered the followino resolution; ~ Pv'HEREAS, the total assess valuation of this district amounts to $5000528.00 and it is necessary to raise the sum of i ~ . _ ~)13000.00 for the expenses of every kind for the coming year, and ~ IVHEREAS, it has been found after deducting 15% from said assessed valuation as required by lavd a levy of 32j on a dollar which amounts to $130000.00. , - NOW, THIREFORE, be it, and it hereby is resolved that the tax levy of the Cardiff Irrigation District for the year 1916-1917 shall be the sum of 3N cents on each dollar of valuation, being duly seconded , was unanimously adopted. The president than instructed the secretary to immediat6ly proceed and figure the tax for the said P:,Istrict set tilem dovai in tiiN assess.merii, aook provide3 for said purpose as required by law and to as soon as possible return said assessme nt book to the tax ~ collector of the District. ' ~ The secretary was requested to notify tne said collector to within 20 days, publish a notice in a newspaper in San Die~o County; tnat one-half of said assessment is due and payable and will become delinquent at G o' clock P.M. on the last monday of December,1916. Mr. Minney than stated, that the needs of the District were such as to require the purchase of a terlporAry water supply or suf- ficient for the needs of the District pending the bond issue already outlined by this Board, and, stated that Mr. J. Frank Cullen nad offered to s ell to the District, portion of the water system owned by him located on East Slock Two in Encinitas and the distributing main connecting said Block Two and the town of Cardiff f'or the sum of $10,000.00 . The Boarci bein~ advised by ~Vir. Ginder, their attor- ney that it mic-ht legally purchase this system for a price not to ~ exceed $10,000.00 ~ The following resoiution was then presented by E.E.young, ~ WHEREAS, the General Laws of the State of California, in respect to IrriZation Districts provide for purchase by said District, without submitting same to the people of the District, of property not to exceed in valuation ten thousand dollars, and Wf-IE;rEAS, this Board Y~,as received a written proposition from J. Frank Cullen, oi'fering to sell the water system owned by him lacoated on 11'ast Block Two in Ehcinitas, a nd tYie main supply pipe , extending from said Block jwo to the town of Cardiff, for the sum of $10,000.00 to be paid in the follovring manner; $3000.00 in 1916; $3500.00 in 1917 and $3500.00 in 1918, and VIHERE S, it is deemed by this Soard that said price is a fair and proper sum and that said systern is fully dvorth said price. Now, Therefore, be it, and it hereby is RrSOLVED, that this District accept the proposition of said J. Frank Cull:en. That the attorney of the Di strict be ira- structed to prepare a contract embodying the terms of said offer and that s aid contract be signed and a cknowledged on behalf of the Listrict, by Director J. L Minney; That the Secretary be instructed to attest same and affix the seal of the District to the contract. The presicient called for a vote thereon -ghich resulted as follows: E. E. Youno, aye; J. L. Minney, aye, J. Frank Cullen not voting. The president requested that IvIr. I will prepare all pla ns, specificat-ions and contracts nec- essary and suAervise the construetion of said pumping and distributior - system for a fee of five per cent. on the total cost of the work, either - based oiq the estimated ~?56,200 cost as given in my report or on the f fixlal eost to be ae~Sua*e~ on eompletion of thLe work, as the District may p refer.
